CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1565 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> MARSH/SMITH ASSOCIATES FOR REZONING AND <br /> DEVELOPMENT PLAN APPROVAL AS FILED UNDER CASE <br /> PUD-91-03 <br /> <br />WHEREAS, Marsh/Smith Associates has applied for development plan <br /> approval for a 29-1ot single-family development on an <br /> approximately 18.6 acre site generally located at the <br /> southeast corner of the Sunol Boulevard undercrossing of <br /> Interstate 680 and for rezoning of the site from <br /> Industrial Park (I-P) to the Planned Unit Development - <br /> Low Density Residential (PUD-LDR) District; and <br /> <br />WHEREAS, an Environmental Impact Report (EIR) was prepared for <br /> this project and on June 16, 1992, a resolution <br /> certifying the EIR as complete and adequate was adopted; <br /> and <br /> <br />WHEREAS, the Environmental Impact Report disclosed several <br /> possible significant adverse impacts, most of which could <br /> be mitigated, but one adverse cumulative impact which was <br /> considered significant and unavoidable; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the development plan and <br /> rezoning; and <br /> <br />WHEREAS, both staff and Planning Commission have recommended that <br /> benefits of the project - social, economic, and <br /> environmental/land use - outweigh the few significant <br /> adverse environmental impacts, thereby justifying <br /> approval of the project; and <br /> <br /> WHEREAS, a duly noticed public hearing was held on June 16, 1992; <br /> and <br /> <br /> WHEREAS, the City Council has approved the application for a <br /> General Plan amendment to redesignate this property as <br /> Low Density Residential; and <br /> <br /> WHEREAS, the City Council finds that this development plan and <br /> zoning is consistent with the General Plan land use <br /> designation of the site and the General Plan policies of <br /> the City of Pleasanton. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> <br />
