Property lines shall be located a minimum of two feet from <br /> the top of all slope banks. <br /> <br /> construction Phase <br /> <br /> 75. Construction activities during the nesting season of raptors <br /> (March to July) shall be preceded by pre-construction <br /> surveys. by a qualified ornithologist for any threatened or <br /> endangered raptors which may be nesting. No construction <br /> activities shall proceed which would result in disturbance <br /> to active nests of any threatened or endangered raptors as <br /> protected by the federal laws. <br /> <br />76. The hours of construction activities in areas bordering <br /> existing, adjacent development to the west and north of the <br /> site (i.e. particularly the construction of Hearst Drive and <br /> the golf course) shall be limited to between the hours of <br /> 8 am and 5 pm. <br /> <br />77. The haul route for all materials to and from this <br /> development shall be approved by the City Engineer prior to <br /> the start of any construction. The developer shall <br /> construct a temporary road separate from existing <br /> residential development directly from the site northerly to <br /> Vineyard Avenue to serve as a haul route for heavy <br /> construction traffic during the initial site construction <br /> phases of the project. <br /> <br />78. Any proposed phasing of this development shall be depicted <br /> on the tentative tract map and shall include narrative <br /> explaining and proposed phasing. Unless a phasing plan for <br /> improvements is approved by the Planning Director, the <br /> developer shall complete all of the on-site improvements at <br /> one time (including all improvements around future building <br /> pads). All remaining pad areas shall be seeded and kept in <br /> a neat and weed-free manner at all times. <br /> <br />79. In the event that any archeological materials are discovered <br /> during grading or any other construction phases of the <br /> project, the City shall be notified immediately and all work <br /> shall be halted within 100 feet of the discovery until a <br /> qualified archaeologist has been retained to inspect the <br /> find and to determine its areal extent. If applicable, the <br /> county coroner and the Native American Heritage Commission <br /> shall also be notified and procedures followed as required <br /> in Appendix K of the California Environmental Quality Act. <br /> If, upon inspection, it is determined that further <br /> improvement work will impact cultural resources, it will be <br /> the responsibility of the archaeologist to devise a plan for <br /> in-field evaluation and/or mitigation of impacts to any <br /> materials endangered by renewed work. <br /> <br /> 18 <br /> <br /> <br />
