CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1695 <br /> <br /> AN ORDINANCE AMENDING SECTION 1 (PART) OF <br /> ORDINANCE 1370 AND SECTION 19.44.090 OF THE <br /> PLEASANTON MUNICIPAL CODE CONCERNING <br /> CREDIT FOR PARK OPEN SPACE <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN <br />AS FOLLOWS: <br /> <br />Section 1: Section 1 (part) of Ordinance No. 1370 and Section 19.44.090 of the <br /> Pleasanton Municipal Code are hereby amended to read as follows: <br /> <br /> "19.44.090 Credit for private open space. <br /> <br /> A. No credit shall be given for private open space in the subdivision or <br /> project except as provided in this Section. Where private open space usable <br /> for active recreational purposes is provided in a proposed planned <br /> development or real estate development as defined in Sections 11003 and <br /> 11003.1 of the Business and Professions Code, partial credit, as set forth in <br /> subsection B of this section, shall be given against the requirement of land <br /> dedication or payment of fees in lieu thereof, if the City Council fmds that <br /> it is in the public interest to do so and that all the following standards are <br /> met: <br /> <br /> (Paragraphs 1 - 6, no change). <br /> <br /> B. Where the City Council gives a credit for private open space, the <br /> percentage of the maximum credit shall be calculated based on the <br /> proportion of neighborhood parkland to the overall <br /> neighborhood/community parkland in the City at the time the credit is <br /> requested; provided, however, that the credit shall at no time exceed 50 <br /> percent (50%). Nothing provided in this section means that the City <br /> Council must give the maximum credit allowable. <br /> <br /> (Reletter the existing subsection B to C; otherwise, no change.)" <br /> <br /> <br />
