CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1686 AN ORDINANCE APPROVING AN AMENDMENT TO THE DEVELOPMENT AGREEMENT BETWEEN THE CITY OF PLEASANTON AND BERNAL AVENUE ASSOCIATES GOVERNING THE BERNAL CORPORATE PARK WHEREAS, Government Code Section 65865 through Section 65869.5 authorizes cities and counties to enter into and to amend development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, Bernal Avenue Associates has made application to the City for an amendment to the its development agreement with the City to extend its term for seven years, to October 1, 2005; and WHEREAS, Council received the Planning Commission' s recommendations for approval of the proposed amendment to the development agreement; and WHEREAS, no environmental document is required for this amendment; and WHEREAS, a duly noticed public hearing was held on July 9, 1996; and WHEREAS, the Council finds that the amendment to the development agreement between the City of Pleasanton and Bernal Avenue Associates is consistent with the City' s General Plan. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: The Council approves the amendment to the development agreement between the City of Pleasanton and the Bernal Avenue Associates, extending the term of the Development Agreement for seven years, to October 1, 2005. Section 2: Authorizes the appropriate City officials to execute the above-referenced Amendment when approved as to form by the City Attorney. Section 3: A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption.
