CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1661 AN ORDINANCE APPROVING THE APPLICATION OF MICHAEL AND LINDA KLIMENT FOR REZONING APPROVAL, AS FILED UNDER CASE RZ-95-03 WHEREAS, Michael and Linda Kliment have applied to rezone an approximately 1.153 acre parcel located at 5142 Foothill Road from the "Agricultural" District and the "Planned Unit Development - Low Density Residential" District to the R-l-40,000 District (Single-family Residential - minimum 40,000 sq. ft. lot size); and WHEREAS, zoning for the property is Agricultural and PUD (Planned Unit Development) - Low Density Residential District; and WHEREAS, projects of this nature are categorically exempt from the requirements of CEQA (California Environmental Quality Act) and no environmental document was prepared for this application; and WHEREAS, Council received the Planning Commission's recommendation for approval of the rezoning; and WHEREAS, a duly noticed public hearing was held on September 5, 1995; and WHEREAS, the City Council finds that the proposed rezoning would bring the parcel into conformante with the City's General Plan designation and provide one consistent zoning designation for the Kliment propony. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves Case RZ-95-03, the application of Michael and Linda Kliment to rezoning an approximately 1. 153 acre parcel located at 5142 Foothill Road from the "Agricultural" District and the "Planned Unit Development - Low Density Residential" District to the R-l-40,000 (single-family residential - minimum 40,000 sq. ft. lot size) District. Section 2: The Zoning Map of the City of Pleasanton dated April 18, 1960, on file with the City Clerk, designating and dividing the City into zoning districts is hereby amended by Zoning Unit Map #426, attached hereto as Exhibit "A", dated 9/5/95, and incorporated herein by reference.
