CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1661 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> MICHAEL AND LINDA KLIMENT FOR REZONING <br /> APPROVAL, AS FILED UNDER CASE RZ-95-03 <br /> <br />WHEREAS, Michael and Linda Kliment have applied to rezone an approximately 1.153 acre <br /> parcel located at 5142 Foothill Road from the "Agricultural" District and the <br /> "Planned Unit Development - Low Density Residential" District to the <br /> R-l-40,000 District (Single-family Residential - minimum 40,000 sq. ft. lot size); <br /> and <br /> <br />WHEREAS, zoning for the property is Agricultural and PUD (Planned Unit Development) - <br /> Low Density Residential District; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of CEQA <br /> (California Environmental Quality Act) and no environmental document was <br /> prepared for this application; and <br /> <br />WHEREAS, Council received the Planning Commission's recommendation for approval of the <br /> rezoning; and <br /> <br />WHEREAS, a duly noticed public hearing was held on September 5, 1995; and <br /> <br />WHEREAS, the City Council finds that the proposed rezoning would bring the parcel into <br /> conformante with the City's General Plan designation and provide one consistent <br /> zoning designation for the Kliment propony. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves Case RZ-95-03, the application of Michael and Linda Kliment to <br /> rezoning an approximately 1. 153 acre parcel located at 5142 Foothill Road from <br /> the "Agricultural" District and the "Planned Unit Development - Low Density <br /> Residential" District to the R-l-40,000 (single-family residential - minimum <br /> 40,000 sq. ft. lot size) District. <br /> <br />Section 2: The Zoning Map of the City of Pleasanton dated April 18, 1960, on file with the <br /> City Clerk, designating and dividing the City into zoning districts is hereby <br /> amended by Zoning Unit Map #426, attached hereto as Exhibit "A", dated <br /> 9/5/95, and incorporated herein by reference. <br /> <br /> <br />
