CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1655 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> CHEVYS RESTAURANT FOR A MAJOR MODIFICATION <br /> TO AN APPROVED PUD DEVELOPMENT PLAN, AS FILED <br /> UNDER CASE PUD-85-8-4D-2M <br /> <br />WHEREAS, Chevys Restaurant has applied for a major modification to an approved <br /> development plan PUD-85-8-4D (Retail Properties) for a retail commercial <br /> complex to allow an approximately 1,550 square foot addition to an existing <br /> restaurant (Chevys), a reduction in the gross square footage for a future retail <br /> building, and reconfiguration of the parking and landscaped areas on an <br /> approximately 3.16 acre site in the Hacienda Business Park located at 5877 <br /> Owens Drive; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - I/C-O (Industrial/ <br /> Commercial and Office) District; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br /> California Environmental Quality Act; and <br /> <br />WHEREAS, Council received the Planning Commission' s recommendations for approval of the <br /> proposed major modification to the approved planned unit development; and <br /> <br />WHEREAS, a duly noticed public hearing was held on May 16, 1995; and <br /> <br />WHEREAS, the City Council finds that as conditioned, the proposed major modification to the <br /> restaurant and site plan would be appropriate for this commercial location and <br /> consistent with the Hacienda Business Park Design Guidelines and is consistent <br /> with the General Plan policies of the City of Pleasanton. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves Case PUD-85-8-4D-2M, the application of Chevys Restaurant for a <br /> major modification to an approved development plan PUD-85-8-4D (Retail <br /> Properties) for a retain commercial complex to allow an approximately 1,550 <br /> square foot addition to an existing restaurant (Chevys), a reduction in the gross <br /> square footage for a future retail building, and reconfiguration of the parking and <br /> landscaped areas on an approximately 3.16 acre site i the Hacienda Business Park <br /> located at 5877 Owens Drive, subject to the conditions on "Exhibit B" attached <br /> hereto and by this reference incorporated herein. <br /> <br /> <br />
