CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1650 AN ORDINANCE APPROVING A DEVELOPMENT AGREEMENT, AS AMENDED, BETWEEN THE CITY OF PLEASANTON AND THE RUBY HILL DEVELOPMENT JOINT VENTURE L.P. REGARDING THE RUBY HILL PROJECT WHEREAS, Government Code Section 65865 through Section 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, the Ruby Hill Development Joint Venture L.P. made application to the City (and to the County) for such a development agreement for the Ruby Hill project; and WHEREAS, the County has certified an EIR for this project; and WHEREAS, a duly noticed public hearing was held on November 17, 1992; and WHEREAS, the City Council approved the Development Agreement and authorized the appropriate City officials to sign said Agreement; and WHEREAS, inadvertently, an ordinance approving the Development Agreement was not adopted at that time; and WHEREAS, the Development Agreement was signed by appropriate City officials and thereafter recorded in the Alameda County Recorder's Office on June 15, 1993, Instrument No. 93-210619; and WHEREAS, on September 19, 1993, after a noticed public hearing, the City Council approved an amendment to the Development Agreement, which amendment was signed and recorded on October 29, 1993, in the Alameda County Recorder's Office, Instrument No. 93-385518; and WHEREAS, no ordinance approving that amendment was adopted at that time; and WHEREAS, recently it came to the City's attention that an ordinance adopting the Development Agreement, as amended, had not been adopted; and WHEREAS, City Council considered this item at its meeting on February 21, 1995 and at that time introduced this ordinance and adopted it at its meeting of March 7, 1995;
