CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1649 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> RUBY HILL JOINT VENTURE, L.P., A MAJOR <br /> MODIFICATION TO AN APPROVED PUD DEVELOPMENT <br /> PLAN, AS FILED UNDER CASE PUD-93-02-1M <br /> <br />WHEREAS, Ruby Hill Joint Venture, L.P. has applied for a major modification to an <br /> approved development plan for the Phase II portion of the Ruby Hill project to <br /> allow revisions to the approved grading plan and lotting patterns, said project <br /> being bounded generally by Vineyard Avenue on the north and northeast, <br /> Vallecitos Road to the south and southeast, and the City of Livermore to the east; <br /> and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - A/OS/LDR <br /> (Agriculture/Open Space/Low Density Residential) District; and <br /> <br />WHEREAS, an Environmental Impact Report was prepared for the Ruby Hill development <br /> plan with the County of Alameda acting as Lead Agency and the proposed <br /> modifications are not in confiict with the EIR or the adopted mitigation measures; <br /> therefore, no new environmental document was prepared for this application; and <br /> <br />WHEREAS, Council received the Planning Commission's recommendations for approval of the <br /> proposed major modification to the approved planned unit development; and <br /> <br />WHEREAS, a duly noticed public hearing was hdld on February 21, 1995; and <br /> <br /> WHEREAS, the City Council finds that the proposed modifications maintain the original intent <br /> of the plan. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> Section 1: Approves Case PUD-93-02-1M, the application of Ruby Hill Joint Venture, L.P. <br /> for a major modification to an approved development plan for the Phase II portion <br /> of the Ruby Hill project to allow revisions to the approved grading plan and <br /> lotting patterns, subject to the conditions on "Exhibit B", attached hereto and by <br /> this reference incorporated herein. <br /> <br /> <br />
