CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1649 AN ORDINANCE APPROVING THE APPLICATION OF RUBY HILL JOINT VENTURE, L.P., A MAJOR MODIFICATION TO AN APPROVED PUD DEVELOPMENT PLAN, AS FILED UNDER CASE PUD-93-02-1M WHEREAS, Ruby Hill Joint Venture, L.P. has applied for a major modification to an approved development plan for the Phase II portion of the Ruby Hill project to allow revisions to the approved grading plan and lotting patterns, said project being bounded generally by Vineyard Avenue on the north and northeast, Vallecitos Road to the south and southeast, and the City of Livermore to the east; and WHEREAS, zoning for the property is PUD (Planned Unit Development) - A/OS/LDR (Agriculture/Open Space/Low Density Residential) District; and WHEREAS, an Environmental Impact Report was prepared for the Ruby Hill development plan with the County of Alameda acting as Lead Agency and the proposed modifications are not in confiict with the EIR or the adopted mitigation measures; therefore, no new environmental document was prepared for this application; and WHEREAS, Council received the Planning Commission's recommendations for approval of the proposed major modification to the approved planned unit development; and WHEREAS, a duly noticed public hearing was hdld on February 21, 1995; and WHEREAS, the City Council finds that the proposed modifications maintain the original intent of the plan. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves Case PUD-93-02-1M, the application of Ruby Hill Joint Venture, L.P. for a major modification to an approved development plan for the Phase II portion of the Ruby Hill project to allow revisions to the approved grading plan and lotting patterns, subject to the conditions on "Exhibit B", attached hereto and by this reference incorporated herein.
