Exhibit B <br /> Color THe and Carpet Retail Store <br /> PUD 80-15-5D-5M <br /> City Council, December 6, 1994 <br /> Proposed Conditions of Approval <br /> <br /> 1. The proposed development plan and business operation shall conform substantially to the <br /> site plan, architectural plans, and sign plan, Exhibit A (dated "Received September 28, <br /> 1994"), on file with the Planning Department, except as may be modified by these <br /> conditions. Minor changes to the plans may be allowed subject to the approval of the <br /> Planning Director if found to be in substantial conformance with the approved exhibits. <br /> <br /> 2. i. There shall be no loading, unloading or deliveries at any time to the Color Tile site at its <br /> single rear door. The proposed rear double doors and exterior concrete ramp at the rear <br /> door are not approved as part of this modification. <br /> <br /> ii. The owner shall maintain the gate at the rear landscape area and provide access only for <br /> City maintenance and emergency vehicles and for emergency purposes. The gate shall <br /> remain locked and comply with the Uniform Building Code. <br /> <br /> 3. The applicants shall obtain all building and other applicable City permits' for the project <br /> prior to the commencement of construction. <br /> <br /> 4. The approval to permit external and internal modifications to the structure will lapse <br /> within one year from the date of approval unless a building permit is issued and <br />_ . construction has commenced and is diligently pursued toward completion. <br /> <br /> 5. Final inspection by the Planning Department is required prior to occupancy. <br /> <br /> 6. The developer shall pay any and all fees in effect in the City generally which apply to the <br /> property prior to the issuance of a building permit. <br /> <br /> 7. All ducts, meters, air conditioning equipment, and any other mechanical equipment, shall <br /> be entirely screened from all view by the existing parapet wall. A plan showing all <br /> equipment and how it will be effectively screened from view using the existing parapet <br /> wall shall be shown on the plans submitted for issuance of a building permit. <br /> <br /> 8. All mechanical equipment shall be constructed in such a manner that noise emanating from <br /> it will not be perceptible beyond the property plane of the subject property in a normal <br /> environment for that zoning district. <br /> <br /> 9. Any damage to existing street improvements caused by the applicant and/or its contractors <br /> during construction on the subject property shall be repaired to the satisfaction of the City <br /> Engineer at full expense to the developer. This shall include slurry seal, overlay, or street <br /> reconstruction if deemed warranted by the City Engineer. <br /> <br /> <br />
