CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1643 <br /> <br /> AN ORDINANCE AMENDING SECTIONS 11.44.020 AND <br /> 11.44.030 OF THE PLEASANTON MUNICIPAL CODE <br /> REGARDING ABANDONED VEHICLE ABATEMENT <br /> <br />WHEREAS, State law allows each county and its cities to establish a Joint Powers Authority <br /> to receive state funding from a $1 per vehicle registration surcharge for the <br /> purpose of funding local agencies' abatement of abandoned vehicles; and <br />WHEREAS, the Alameda County Abandoned Vehicle Abatement District (the DistdcO was <br /> formed to receive and disburse funds to local agencies to fund the abatement of <br /> abandoned vehicles; and <br /> <br />WHEREAS, the City of Pleasanton is a member of the District; and <br /> WHEREAS, the California Highway Patrol, which oversees the state funding, has identified <br /> specific changes that must be made to Section 11.4.020 and 11.44.030 of <br /> Pleasanton's Municipal Code if Pleasanton is to remain eligible to receive funding <br /> through the program; <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> Section 1..: Sections 11.44.020 and 11.44.030 of the Pleasanton Municipal Code are amended <br /> as follows: <br /> <br /> 11.44.020 ~ <br /> The accumulation and storage of abandoned, wrecked, dismantled or <br /> inoperative vehicles or parts thereof on private or public property including <br /> highways is found to create a condition tending to reduce the value of private <br /> property, to promote blight and deterioration, to invite plundering, to create fire <br /> hazards, to constitute an attractive nuisance creating a hazard to the health and <br /> safety of minors, to create a harborage for rodents and insects and to be injurious <br /> to the health, safety and general welfare. Therefore, the presence of an <br /> abandoned, wrecked, dismantled or inoperative vehicle or parts thereof, on <br /> private or public property including highways, except as expressly permitted in <br /> this Chapter, constitutes a public nuisance which may be abated as such in <br /> accordance with the provisions of this chapter. <br /> <br /> <br />
