CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1643 AN ORDINANCE AMENDING SECTIONS 11.44.020 AND 11.44.030 OF THE PLEASANTON MUNICIPAL CODE REGARDING ABANDONED VEHICLE ABATEMENT WHEREAS, State law allows each county and its cities to establish a Joint Powers Authority to receive state funding from a $1 per vehicle registration surcharge for the purpose of funding local agencies' abatement of abandoned vehicles; and WHEREAS, the Alameda County Abandoned Vehicle Abatement District (the DistdcO was formed to receive and disburse funds to local agencies to fund the abatement of abandoned vehicles; and WHEREAS, the City of Pleasanton is a member of the District; and WHEREAS, the California Highway Patrol, which oversees the state funding, has identified specific changes that must be made to Section 11.4.020 and 11.44.030 of Pleasanton's Municipal Code if Pleasanton is to remain eligible to receive funding through the program; THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1..: Sections 11.44.020 and 11.44.030 of the Pleasanton Municipal Code are amended as follows: 11.44.020 ~ The accumulation and storage of abandoned, wrecked, dismantled or inoperative vehicles or parts thereof on private or public property including highways is found to create a condition tending to reduce the value of private property, to promote blight and deterioration, to invite plundering, to create fire hazards, to constitute an attractive nuisance creating a hazard to the health and safety of minors, to create a harborage for rodents and insects and to be injurious to the health, safety and general welfare. Therefore, the presence of an abandoned, wrecked, dismantled or inoperative vehicle or parts thereof, on private or public property including highways, except as expressly permitted in this Chapter, constitutes a public nuisance which may be abated as such in accordance with the provisions of this chapter.
