CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1638 AN ORDINANCE APPROVING SECOND A1VIENDMENT TO THE PHASE I AND PHASE H DEVELOP1VIENT AGREEMENTS BETWEEN THE CITY OF PLEASANTON AND PRUDENTIAL INSURANCE COMPANY GOVERNING THE HACIENDA BUSINESS PARK WHEREAS, Government Code Section 65865 through Section 65869.5 authorizes cities and counties to enter into and to amend development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, Prudential Insurance Company has made application to the City for a Second Amendment to the Phase I and Phase II Development Agreements to reflect the addition of Lot iF; and WHEREAS, the addition of Lot 1F in the Development Agreements will not have any impact on any other part of the Agreements; and WHEREAS, Council received the Planning Commission 's recommendations for approval of the proposed Second Amendment to the Development Agreements; and WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by Council on September 6, 1994; and WHEREAS, a duly noticed public hearing was held on September 6, 1994; and WHEREAS, the Council finds that the Second Amendment to the Development Agreements between the City of Pleasanton and the Prudential Insurance Company are consistent with the City's General Plan. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: The Council approves the Second Amendment to the Development Agreements between the City of Pleasanton and the Prudential Insurance Company, the final form of which is to be approved by the City Attorney. Section 2.: Authorizes the appropriate City officials to execute the above-referenced Amendment when approved as to form by the City Attorney.
