CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1638 <br /> <br /> AN ORDINANCE APPROVING SECOND A1VIENDMENT TO <br /> THE PHASE I AND PHASE H DEVELOP1VIENT <br /> AGREEMENTS BETWEEN THE CITY OF PLEASANTON <br /> AND PRUDENTIAL INSURANCE COMPANY GOVERNING <br /> THE HACIENDA BUSINESS PARK <br /> <br />WHEREAS, Government Code Section 65865 through Section 65869.5 authorizes cities and <br /> counties to enter into and to amend development agreements with persons having <br /> legal or equitable interests in real property for the development of such property; <br /> and <br /> <br />WHEREAS, Prudential Insurance Company has made application to the City for a Second <br /> Amendment to the Phase I and Phase II Development Agreements to reflect the <br /> addition of Lot iF; and <br /> <br />WHEREAS, the addition of Lot 1F in the Development Agreements will not have any impact <br /> on any other part of the Agreements; and <br /> <br />WHEREAS, Council received the Planning Commission 's recommendations for approval of the <br /> proposed Second Amendment to the Development Agreements; and <br /> <br /> WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by <br /> Council on September 6, 1994; and <br /> <br /> WHEREAS, a duly noticed public hearing was held on September 6, 1994; and <br /> WHEREAS, the Council finds that the Second Amendment to the Development Agreements <br /> between the City of Pleasanton and the Prudential Insurance Company are <br /> consistent with the City's General Plan. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> Section 1: The Council approves the Second Amendment to the Development Agreements <br /> between the City of Pleasanton and the Prudential Insurance Company, the final <br /> form of which is to be approved by the City Attorney. <br /> <br /> Section 2.: Authorizes the appropriate City officials to execute the above-referenced <br /> Amendment when approved as to form by the City Attorney. <br /> <br /> <br />
