CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1632 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> DAVIDON HOMES FOR A MAJOR MODIFICATION TO AN <br /> APPROVED PUD DEVELOP1VIENT PLAN AS FILED UNDER <br /> CASE pUD-89-5-1D-2M <br /> <br />WHEREAS, Davidon Homes has applied for a major modification to an approved planned unit <br /> development (Laguna Oaks Subdivision) for Land Unit A to: 1) modify the <br /> required side yard setback and separation requirements of the 13 1 production lots; <br /> 2) modify the private recreation area; and 3) modify the production lot house <br /> plans located on an approximately 109 acre site at the northeast intersection of <br /> Foothill Road and Bernal Avenue; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Developmen0 - Low Density <br /> Residential District; and <br /> <br /> WHEREAS, an Environmental Impact Report (EIR) was previously prepared and adopted for <br /> the Stoneridge Meadows Specific Plan, which preceded the Laguna Oaks Specific <br /> Plan and PUD submittals of the subject property. The Laguna Oaks development <br /> plan (PUD-89-5-1D) and the preceding approved master PUD plan (PUD-89-5) <br /> incorporated the mitigation measures recommended in the EIR. Therefore, no <br /> additional environmental document was prepared for this application; and <br /> <br /> WHEREAS, Council received the Planning Commission's recommendations for approval of the <br /> proposed major modification to the approved planned unit development; and <br /> <br /> WHEREAS, a duly noticed public hearing was held on July 19, 1994; and <br /> <br /> WHEREAS, in March of 1990, the City Council approved Case PUD-89-5-1D, the application <br /> of the DeSilva Group for final PUD development plan approval for the 251 lot <br /> Laguna Oaks development, described in Exhibit A, Previously Approved Site <br /> Plan, House Plans, and Private Recreation Area Plan, on f~e with the Planning <br /> Department; and <br /> <br /> WHEREAS, the City Council finds that the proposed changes to Land Unit A are appropriate <br /> and would not significantly affect the development plan concept approved as part <br /> of PUD-89-5 and PUD-89-5-1D. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> <br />
