CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1630 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> TONY CttAN FOR A MAJOR MODIFICATION TO AN <br /> APPROVED PLANNED UNIT DEVELOPMENT AS FILED <br /> UNDER CASE NUMBER PUD-82-13-3M <br /> <br />WHEREAS, Tony Chan has applied for a major modification to an approved planned unit <br /> development (PUD-82-13) to allow for the removal of four existing heritage <br /> eucalyptus trees on the property located at One Deer Oaks Drive; and <br /> <br />WHEREAS, zoning for the proper~y is PUD (Planned Unit Development) Low Density <br /> Residential/Open Space District; and <br /> <br />WHEREAS, the PUD-82-13 was approved in September, 1982, and this is the third <br /> modification; and <br /> <br />WHEREAS, the requested major modification is reasonable and would not violate the original <br /> intent of this PUD; and <br /> <br /> WHEREAS, Council received the Planning Commission' s recommendations for approval of the <br /> proposed major modification to the approved planned unit development; and <br /> <br />WHEREAS, an EIR was previously prepared and adopted for the project and the scope of this <br /> modification falls within the scope of the previous environmental document; and <br /> <br /> WHEREAS, a duly noticed public hearing was held on July 5, 1994; and <br /> <br /> WHEREAS, the City Council finds that this major modification is consistent with the General <br /> Plan policies of the City of Pleasanton. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> Section 1: Approves Case PUD-82-13-3M, the application of Tony Chan for a major <br /> modification to an approved planned unit development (PUD-82-13) to allow for <br /> the removal of four existing heritage eucalyptus trees on the property located at <br /> One Deer Oaks Drive, subject to the following condition: <br /> <br /> <br />
