CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1629 AN ORDINANCE APPROVING THE APPLICATION OF PETER SHUTTS FOR A MAJOR MODIFICATION TO AN APPROVEI) PUD DEVELOPNrENT PLAN AS FILED UNDER CASE PUD-91-19-1M WHEREAS, Peter Shutts has applied for a major modification to a Planned Unit Development plan to eliminate or extend the June 5, 1994, expiration date for the construction of a single-family home on a 1.25 acre portion of an approximately 2.40 acre site located at 5226 Foothill Road; and WHEREAS, zoning for the property is PUD (Planned Unit Development) - Low Density Residential district; and WHEREAS, applications of this nature are categorically exempt from the requirements of the California Environmental Quality Act (CEQA); and WHEREAS, Council received the Planning Commission' s recommendations for approval of the proposed major modification to the approved planned unit development plan; and WHEREAS, a duly noticed public hearing was held on July 5, 1994; and WHEREAS, the City Council finds that an extension to this development plan would benefit the subdivision of which this lot is a part. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves Case PUD-91-19-1M, the application of Peter Shutts for a major modification to the Planned Unit Development plan to extend the expiration date to June 5, 1997, for the construction of a single-family home on a 1.25 acre portion of an approximately 2.40 acre site located at 5226 Foothill Road, subject to the conditions on "Exhibit B" attached hereto and incorporated herein by this reference. Section 2: A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Valley Times," a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption.
