CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1613 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF THE <br /> DESILVA GROUP~ INC. FOR A MAJOR MODIFICATION <br /> TO AN APPROVED PUD DEVELOPMENT PLAN AS FILED <br /> UNDER CASE PUD-90-20-1M <br /> <br />WHEREAS, the DeSilva Group has applied for a major modification to <br /> an approved PUD development plan to change the 15 <br /> previously approved townhome units to detached single- <br /> family dwelling units and to modify the previously <br /> approved house plans for the site located at the <br /> southwest corner of the Rheem Drive/Oakland Avenue <br /> intersection; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) <br /> - High Density Residential District; and <br /> <br />WHEREAS, a Negative Declaration of Environmental Significance was <br /> previously prepared and adopted with the approval of <br /> PUD-90-20; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the proposed major <br /> modification to the approved planned unit development; <br /> and <br /> <br /> WHEREAS, a duly noticed public hearing was held on November 2, <br /> 1993; and <br /> <br /> WHEREAS, the City Council determined'that no new information of <br /> significance has been discovered which would affect the <br /> previously approved Negative Declaration; and <br /> <br /> WHEREAS, the City Council finds that the design of the site's <br /> layout and the design of the homes are compatible with <br /> the surrounding neighborhood, <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> Section 1: Approves Case PUD-90-20-1M, the application of the <br /> DeSilva Group for a major modification to an approved PUD <br /> development plan to change the 15 previously approved <br /> townhome units to detached single-family dwelling units <br /> and to modify the previously approved house plans for the <br /> site located at the southwest corner of the Rheem <br /> Drive/Oakland Avenue intersection, subject to the <br /> conditions on "Exhibit B.i", attached hereto and <br /> incorporated herein by this reference. <br /> <br /> <br />
