Ordinance No. 1609 <br />Page Two <br /> <br /> Accordingly, the City Council finds and declares that the <br /> purposes of this ordinance are (1) to protect the public <br /> health and welfare by prohibiting smoking in public <br /> places and in places of employment; (2) to help people to <br /> avoid becoming addicted, and to help people who wish to <br /> quit smoking, by limiting their unintentional exposure to <br /> smoking, tobacco products and inducements to smoke; and <br /> (3) to strike a reasonable balance between the needs of <br /> smokers and the need of nonsmokers to breath smoke-free <br /> air, and to recognize that, where these needs conflict, <br /> the need to breathe smoke-free air shall have priority. <br /> <br /> 9.24.020 Definitions. <br /> <br /> The following words and phrases, whenever used in this <br /> chapter, shall be construed as defined in this section: <br /> <br /> A. Bar means an establishment which is devoted to the <br /> serving of alcoholic beverages, with a type 42, 48 or 62 <br /> license from the California Department of Alcoholic <br /> Beverage Control, in which serving food and providing <br /> coin-operated amusement devices is only incidental to <br /> consuming such beverages. <br /> <br /> B. Business means any sole proprietorship, partnership, <br /> joint venture, corporation or other business entity <br /> formed for profit-making purposes, including retail <br /> establishments where goods or services are sold, as well <br /> as professional corporations and other entities where <br /> legal, medical, dental, engineering, architectural, or <br /> other professional services are delivered. <br /> <br /> C. Dining area means any area containing a counter or tables <br /> where meals are served. <br /> <br /> D. Employee means any person who is employed in <br /> consideration for direct or indirect monetary wages or <br /> profit, and any person who volunteers services for a <br /> nonprofit entity or public agency. <br /> <br /> E. Employer means any person, partnership, corporation or <br /> nonprofit entity, including a municipal corporation or <br /> other public agency, which employs one or more persons. <br /> <br /> F. Enclosed means closed in by a roof and walls on all sides <br /> with appropriate openings for ingress and egress. <br /> <br /> <br />
