CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1598 <br /> <br /> AN ORDINANCE AMENDING ORDINANCE NO. 1227 <br /> (PUD-85-10) TO CORRECT A TECHNICAL ERROR IN <br /> THE PUBLISHED ORDINANCE <br /> <br />WHEREAS, on October 15, 1985, the City Council of the City of <br /> Pleasanton conducted a public hearing on Planned Unit <br /> Development 85-10 concerning the application of Hopyard <br /> Partners for a development plan at Hopyard Village <br /> (Valley Avenue and Hopyard Road); and <br /> <br />WHEREAS, the draft conditions of approval for PUD-85-10, at <br /> Condition 18, provided that a future 7000 square foot <br /> structure shall be used for office only; and <br /> <br />WHEREAS, after the public hearing on this matter was closed, the <br /> City Council introduced Ordinance No. 1227, approving <br /> PUD-85-10, subject to a number of conditions; and <br /> <br />WHEREAS, as specifically referenced in the City Council Minutes <br /> for October 15, 1985, Condition 18 was modified to read <br /> as follows: "that the building [i.e., a future 7000 <br /> square foot structure] be allowed for retail use with the <br /> limitation that it cannot be used for restaurants, fast <br /> food stores, or any high generator of parking space, "' <br /> · -- , <br /> and <br /> <br />WHEREAS, when said Ordinance was held on second reading at the <br /> next regular City Council meeting, inadvertently the <br /> condition inquestion did not get revised as directed by <br /> the City Council and continued to read that the future <br /> 7000 square foot structure shall be used for office only; <br /> and <br /> <br />WHEREAS, inadvertently when the Ordinance was published, the <br /> condition inquestion did not get revised as directed by <br /> the City Council and continued to read that the future <br /> 7000 square foot structure shall be used for office only; <br /> and <br /> <br />WHEREAS, the existence of the published Ordinance with the <br /> incorrectly worded condition recently came to staff's <br /> attention; and <br /> <br />WHEREAS, the Ordinance must be republished in order to correct <br /> this technical error. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br /> <br />
