Exhibit B <br /> <br /> Wastewater Capacity Reservation Guidelines <br /> <br /> This Exhibit B is an exhibit to the "Amendment." On <br />October 31, 1983, City, Developer and Callahan-Pentz <br />Properties, Pleasanton executed that agreement commonly known <br />as (and referred to in this Agreement as) the "Second Amended <br />Willow West Agreement" regarding wastewater reservations <br />relating to the development of Hacienda. As described in the <br />Amendment and in this Exhibit B, the Second Amended Willow West <br />Agreement is superceded and revoked by the Amendment (and this <br />Exhibit B) as it regards the Property. This Exhibit B <br />establishes the new Wastewater Capacity Reservation Guidelines <br />applicable to the Property. <br /> <br />ARTICLE 1. DEFINITIONS <br /> <br /> The definitions contained in this Exhibit B are <br />intended to supplement any definitions set forth in the body of <br />the Amendment and/or the Phase I and Phase II Development <br />Agreements, as applicable. In this Exhibit B, unless the <br />context requires a different meaning, any term or phrase used <br />herein which has its first letter capitalized shall have that <br />meaning given to it by this Exhibit B or by the Amendment. <br /> <br /> "Allocated by City," in reference to sewage capacity, <br />shall mean the number of gallons--Average Day Dry Weather <br /> <br />Flow -- of sewage (measured pursuant to the Pleasanton Sewerage <br />Code in terms of Residential Discharge Equivalents) which may <br />be discharged to the City's wastewater system (sewers, etc.), <br />as specified in particular sewer or building permits issued by <br />City. <br /> <br /> 1 <br /> 7.0/0597 F. 007/051093/l 4123-006 <br /> <br /> <br />
