CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1597 <br /> <br /> AN ORDINANCE APPROVING THE FIRST AMENDMENT TO <br /> THE PBXSE I AND PHASE II DEVELOPMENT <br /> AGREEMENTS BETWEEN THE CITY OF PLEASANTONAND <br /> PRUDENTIAL INSURANCE COMPANY GOVERNING 280.5 <br /> ACRES OF THE HACIENDA BUSINESS PARK <br /> <br />WHEREAS, Government Code Section 65865 through Section 65869.5 <br /> authorizes cities and counties to enter into binding <br /> development agreements with persons having legal or <br /> equitable interests in real property for the development <br /> of such property; and <br /> <br />WHEREAS, Prudential Insurance Company has made application to the <br /> City for an amenament to the following Development <br /> Agreements: Phase I Development Agreements, dated <br /> December 6, 1983, between Prudential and City, and <br /> between CPP and City; and Phase II Development Agreement, <br /> dated April 22, 1986, between Prudential and City; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative <br /> declaration was adopted by Council on June 1, 1993; and <br /> <br />WHEREAS, Council received the Planning Commission's <br /> recommendations for approval of the proposed amendments <br /> to the Development Agreements; and <br /> <br />WHEREAS, a duly noticed public hearing was held on June 1, 1993. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br /> Section 1: The Council finds that the proposed amendments to the <br /> Development Agreements between the City of Pleasanton and <br /> the Prudential Insurance Company are consistent with the <br /> City's General Plan. <br /> <br /> Section 2: Approves the amendments to the Development Agreements <br /> between the City of Pleasanton, and the Prudential <br /> Insurance Company, draft copies of which are attached <br /> hereto and incorporated hereinbythis reference, and the <br /> final forms of which are to be approved by the City <br /> Attorney. <br /> <br /> t~: Authorizes the appropriate City officials to execute <br /> the above-referenced amendments. <br /> <br /> <br />
