CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1597 AN ORDINANCE APPROVING THE FIRST AMENDMENT TO THE PBXSE I AND PHASE II DEVELOPMENT AGREEMENTS BETWEEN THE CITY OF PLEASANTONAND PRUDENTIAL INSURANCE COMPANY GOVERNING 280.5 ACRES OF THE HACIENDA BUSINESS PARK WHEREAS, Government Code Section 65865 through Section 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, Prudential Insurance Company has made application to the City for an amenament to the following Development Agreements: Phase I Development Agreements, dated December 6, 1983, between Prudential and City, and between CPP and City; and Phase II Development Agreement, dated April 22, 1986, between Prudential and City; and WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by Council on June 1, 1993; and WHEREAS, Council received the Planning Commission's recommendations for approval of the proposed amendments to the Development Agreements; and WHEREAS, a duly noticed public hearing was held on June 1, 1993. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: The Council finds that the proposed amendments to the Development Agreements between the City of Pleasanton and the Prudential Insurance Company are consistent with the City's General Plan. Section 2: Approves the amendments to the Development Agreements between the City of Pleasanton, and the Prudential Insurance Company, draft copies of which are attached hereto and incorporated hereinbythis reference, and the final forms of which are to be approved by the City Attorney. t~: Authorizes the appropriate City officials to execute the above-referenced amendments.
