2. If an affordable housing project developer wishes to modify its phasing <br /> schedule, fails to secure all the building permits for which it was granted an <br /> allocation in any calendar year, or allows a building permit to lapse, it shall <br /> follow any rules established as a part of its growth management agreement. <br /> If no special rules are contained in its agreement, it shall apply to, or be <br /> referred to, the City Council for its decision as to whether to allow a <br /> reallocation of the project. The Council may reallocate the project as it <br /> deems best meets the needs of the City. If the project has not begun, the <br /> City Council may void the growth management approval. <br /> <br /> 3. In the event a project's phasing schedule is revised or voided, any unused <br /> affordable housing project sub-allocation shall be available for use by a <br /> different qualifying project in that calendar year and, if it remains unused, it <br /> shall be carried over and shall be available for use by the same or a different <br /> qualifying affordable housing project in the following years. <br /> <br />B. Major Project <br /> <br /> 1. A major project developer may be issued building permits up to the <br /> maximum yearly number established in its agreement. Permits may be <br /> issued at any time during the calendar year and at any rate. <br /> <br /> 2. Should a major project developer wish to revise its annual allocation, the <br /> following regulations shall apply: <br /> <br /> a. For project developers seeking to move units into a later year or <br /> years: <br /> <br /> (i) Prior to September 1 of a given calendar year, a project's <br /> developer may request a reallocation to a later year of some <br /> or all of its allocation. The Planning Department shall <br /> provide the necessary application forms, and a project <br /> developer must file the application with the Planning <br /> Department. The application shall be accompanied by a fee <br /> established by the resolution establishing fees and the <br /> charges for various Municipal services. <br /> <br /> 15 <br /> <br /> <br />
