The Police Chief may issue a provisional permit to any massage establishment or <br /> massage technician, for a period not to exceed six (6) months, if the applicant is <br /> able to show that substantial compliance with the requirements of this Chapter has <br /> been met and that the remaining compliance can be achieved within the period of <br /> the provisional permit. This six-month provisional permit shall not be renewed. <br /> <br /> 6.24.230 Cease of Business. If at any time during the duration of a permit issued under this <br /> Chapter, a permittee ceases to do business as a massage establishment and/or a <br /> massage technician, the permittee shall: <br /> <br /> A. return any permit issued under this Chapter to the Police Chief within five (5) <br /> business days; and <br /> <br /> B. notify the Business License Department. <br /> <br /> 6.24.240 Inspection. The Police Department shall, from time to time, make an inspection of <br /> each massage establishment for the purpose of determining compliance with this <br /> Chapter. <br /> <br /> 6.24.250 Enforc_______ement. <br /> <br /> A. It is the duty of the Police Chief to enforce rules and regulations in accordance <br /> with this Chapter. <br /> <br /> B. Pursuant to the City's prosetutorial discretion, the City may enforce violations of <br /> the provisions of this Chapter as criminal, civil and/or administrative actions. <br /> <br /> C. Any massage establishment operated, conducted, or maintained contrary to the <br /> provisions of this Chapter shall be unlawful and a public nuisance, and the City <br /> Attorney may in the exercise of discretion, in addition to or in lieu of prosecuting a <br /> criminal action hereunder, commence an action or actions, proceeding or <br /> proceedings, for the abatement, removal and enjoinment thereof, in any manner <br /> provided by law." <br /> <br /> Section 3: ~. The changes provided for in this ordinance shall not affect any <br /> offense or act committed or done or any penalty or forfeiture incurred or any right <br /> established or accruing before the effective date of this ordinance; nor shall it affect <br /> any prosecution, suit or proceeding pending or any judgment rendered prior to the <br /> effective date of this ordinance. <br /> <br /> (nnssa~m) <br /> <br /> <br />
