'~7... ciTY COUNCIL OF THE CITY OF PLEASANTON <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1735 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> EUGENE AND SHIRLEY LAUER FOR PUD PLAN <br /> APPROVAL FOR SIX SINGLE-FAMILY RESIDENTIAL <br /> LOTS, AS FILED UNDER CASE PUD-97-16 <br /> <br />WHEREAS, Eugene and Shirley Lauer have applied for PUD plan approval for six <br /> single-family residential lots, including one existing lot, on an approximately <br /> 5. l-acre site located at 2221 Martin Avenue; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR (Low Density <br /> Residential) District; and <br /> <br />WHEREAS, the proposed PUD plan is covered by the Initial Study and Negative Declaration <br /> approved for Case RZ-97-02, the prezoning and annexation which included the <br /> Lauer property; and <br /> <br />WHEREAS, Council received the Planning Commission's recommendations for approval of the <br /> development plan; and <br /> <br />WHEREAS, a duly noticed public heating was held on January 6, 1998; and <br /> <br />WHEREAS, the City Council finds that the development plan is appropriate for the site. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves Case PUD -97-16, the application of Eugene and Shirley Lauer for PUD <br /> plan approval for six single-family residential lots, including one existing lot, on <br /> an approximately 5.1 -acre site located at 2221 Martin Avenue, subject to the <br /> conditions shown on "Exhibit B", attached hereto and incorporated herein by this <br /> reference. <br /> <br />Section 2: A summary of this ordinance shall be published once within fifteen (15) days after <br /> its adoption in "The Tri-Valley Herald," a newspaper of general circulation <br /> published in the City of Pleasanton, and the complete ordinance shall be posted for <br /> fifteen (15) days in the City Clerk's office within fifteen (15) days after its <br /> adoption. <br /> <br /> <br />
