'~7... ciTY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDINANCE NO. 1735 AN ORDINANCE APPROVING THE APPLICATION OF EUGENE AND SHIRLEY LAUER FOR PUD PLAN APPROVAL FOR SIX SINGLE-FAMILY RESIDENTIAL LOTS, AS FILED UNDER CASE PUD-97-16 WHEREAS, Eugene and Shirley Lauer have applied for PUD plan approval for six single-family residential lots, including one existing lot, on an approximately 5. l-acre site located at 2221 Martin Avenue; and WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR (Low Density Residential) District; and WHEREAS, the proposed PUD plan is covered by the Initial Study and Negative Declaration approved for Case RZ-97-02, the prezoning and annexation which included the Lauer property; and WHEREAS, Council received the Planning Commission's recommendations for approval of the development plan; and WHEREAS, a duly noticed public heating was held on January 6, 1998; and WHEREAS, the City Council finds that the development plan is appropriate for the site. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves Case PUD -97-16, the application of Eugene and Shirley Lauer for PUD plan approval for six single-family residential lots, including one existing lot, on an approximately 5.1 -acre site located at 2221 Martin Avenue, subject to the conditions shown on "Exhibit B", attached hereto and incorporated herein by this reference. Section 2: A summary of this ordinance shall be published once within fifteen (15) days after its adoption in "The Tri-Valley Herald," a newspaper of general circulation published in the City of Pleasanton, and the complete ordinance shall be posted for fifteen (15) days in the City Clerk's office within fifteen (15) days after its adoption.
