Ordinance No. 1734 <br />Page Four <br /> <br />9.16.050 Fees <br /> <br /> The City shall establish, from time to time, a schedule of fees for services provided by <br /> the City to administer and enforce this Chapter. The fee schedule shall include a service <br /> fee for all businesses, which fee shall be collected by the CUPA and transmitted to <br /> CalEPA. The fees shall be set by a separate City Council resolution as part of the City's <br /> Master Fee Schedule. <br /> <br />9.16.060 Enforcement <br /> <br />A. Any person that violates any provision of this Chapter shall be liable for civil or criminal <br /> penalties, as appropriate, to the full extent provided by state law and the Pleasanton <br /> Municipal Code. Violations of this Chapter shall be as provided in Chapters 1.12 and <br /> 1.24 of the Pleasanton Municipal Code. Liability for violations may include, but is not <br /> limited to, liability for administrative civil penalties as provided in Health and Safety <br /> Code Section 255 14.5 and in the Pleasanton Municipal Code. The remedies provided for <br /> under this section are in addition to any the City or any person might have under <br /> applicable law. <br /> <br /> B. Any person or business found to have violated any provision of this Chapter shall be deemed <br /> guilty of a separate offense for each and every day during any portion of which a <br /> violation of this Chapter is committed or continued by such person. <br /> <br /> SECTION 3. Section 20.24.120 is hereby added to Chapter 20.24 (Uniform Fire Code) to read <br /> as follows: <br /> <br /> 20.24.120 -ARTICLE 89 Added- Toxic Gases <br /> <br /> Article 89 of the Uniform Fire Code is added to read as follows: <br /> <br /> Division I General Provisions <br /> <br /> SEC 89.101 Scope <br /> <br /> (a) This article applies to all new facilities where regulated materials subject to <br /> this article are present in concentrations which exceed the Level of Concern <br /> as determined in accordance with this article. <br /> <br /> (b) It is intended that this article supplement, and be used in conjunction with, <br /> other sections of this Chapter and with the Uniform Building Code, 1994 <br /> Edition. <br /> <br /> <br />
