CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDNANCE NO. 1733 <br /> <br /> AN ORDINANCE APPROVING AN AMENDMENT TO THE <br /> DEVELOPMENT AGREEMENT WITH CROCKER <br /> PROPERTIES, INC. <br /> <br />WHEREAS, Government Code Section 65864 through Section 65869.5 authorizes cities and <br /> counties to enter into binding development agreements with persons having legal <br /> or equitable interests in real property for the development of such property; and <br /> <br />WHEREAS, in 1990 the City of Pleasanton adopted Ordinance No. 1472 approving a <br /> development agreement between the City and Crocker Properties, Inc. (Wells <br /> Fargo Bank) for the Stoneridge Corporate Plaza II; and <br /> <br />WHEREAS, Crocker Properties has applied to the City for an amendment to the development <br /> agreement; and <br /> <br />WHEREAS, after public notice, the Planning Commission held a hearing and recommended <br /> approval of the amendment to the development agreement; and <br /> <br />WHEREAS, at its meeting of December 9, 1997, the City Council reviewed the staff report <br /> from the Director of planning and Community Development (SR 97:351) together <br /> with copies of staff reports to the Planning Commission regarding this matter; and <br /> <br />WHEREAS, on December 9, 1997, a duly noticed public hearing was held at which time the <br /> applicant and all other members of the public were offered an opportunity to <br /> present evidence regarding this amendment to the development agreement; and <br /> <br /> WHEREAS, the City Council finds that the amendment to the development agreement is <br /> consistent with the City's General Plan. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br /> Section 1: Approves the First Amendment to the Development Agreement by and between <br /> the City of Pleasanton and Crocker Properties, Inc. in connection with the <br /> development known as Stoneridge Corporate Plaza II, and a draft copy of the First <br /> Amendment is attached hereto and incorporated herein by reference, and the final <br /> form of which is to be approved by the City Attorney. <br /> <br /> <br />
