CITY COUNCIL OF THE CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA ORDNANCE NO. 1733 AN ORDINANCE APPROVING AN AMENDMENT TO THE DEVELOPMENT AGREEMENT WITH CROCKER PROPERTIES, INC. WHEREAS, Government Code Section 65864 through Section 65869.5 authorizes cities and counties to enter into binding development agreements with persons having legal or equitable interests in real property for the development of such property; and WHEREAS, in 1990 the City of Pleasanton adopted Ordinance No. 1472 approving a development agreement between the City and Crocker Properties, Inc. (Wells Fargo Bank) for the Stoneridge Corporate Plaza II; and WHEREAS, Crocker Properties has applied to the City for an amendment to the development agreement; and WHEREAS, after public notice, the Planning Commission held a hearing and recommended approval of the amendment to the development agreement; and WHEREAS, at its meeting of December 9, 1997, the City Council reviewed the staff report from the Director of planning and Community Development (SR 97:351) together with copies of staff reports to the Planning Commission regarding this matter; and WHEREAS, on December 9, 1997, a duly noticed public hearing was held at which time the applicant and all other members of the public were offered an opportunity to present evidence regarding this amendment to the development agreement; and WHEREAS, the City Council finds that the amendment to the development agreement is consistent with the City's General Plan. THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS FOLLOWS: Section 1: Approves the First Amendment to the Development Agreement by and between the City of Pleasanton and Crocker Properties, Inc. in connection with the development known as Stoneridge Corporate Plaza II, and a draft copy of the First Amendment is attached hereto and incorporated herein by reference, and the final form of which is to be approved by the City Attorney.
