14. <br /> <br />Prior to final map approval, the necessity for the installation of a soundwall along the <br />south side of Rose Avenue adjacent to the Fairgrounds shall be determined. In the event <br />that this wall would be needed to facilitate securing the necessary easement across the <br />Fairgrounds to extend the sewer and water lines out to Valley Avenue, the developer shall <br />prepare a landscape plan which represents the final design solution for this area and shall <br />pay for the estimated cost of this wall and necessary landscaping across the project's <br />frontage as required by the City Engineer. In the event that the wall is not needed or its <br />need can not be determined, the developer shall prepare a landscape plan which <br />represents the final design solution under this scenario and shall pay the estimated cost for <br />upgrading the landscaping across the project's frontage as determined by the City <br />Engineer. The money which is collected shall be used to fund the installation of the <br />necessary improvements once other developments in the area proceed. An interim <br />landscape plan shall be submitted to the City Engineer for review and approval which <br />details the initial maintenance and landscape installation activities which would be <br />conducted in conjunction with the development of the project prior to the installation of <br />the ultimate improvements. <br /> <br />15. <br /> <br />This PUD shall be subject to the uses and site development standards of the R-1-10,000 <br />zoning district, except as modified by the design guidelines. <br /> <br />16. <br /> <br />The applicant shall comply with the recommendations of the geotechnical report prepared <br />by Terrasearch dated July 11, 1990 as updated by the Nicholas Engineering Consultants <br />report dated December 29, 1998. The applicant's geotechnical consultant shall review <br />and approve all foundation, retaining wall, and drainage geotechnical aspects of the final <br />development plans to ensure that the recommendations have been properly incorporated <br />into the development. The consultant shall certify by writing on the plans or as otherwise <br />acceptable to the Director of Building Inspection that the final development plan is in <br />conformance with the geotechnical report approved with the project. <br /> <br />17. <br /> <br />The applicant shall provide all buyers with copies of the project conditions of approval <br />and design guidelines. Reference to the conditions and design guidelines shall be made in <br />the deed for the properties, subject to the approval of the City Attomey. <br /> <br />18. <br /> <br />All site improvements and house construction activities shall be limited to the hours of <br />8:00 a.m. to 5:00 p.m., Monday through Saturday. All construction equipment must meet <br />DMV noise standards and shall be equipped with muffling devices.
