CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1747 <br /> <br /> AN ORDINANCE APPROVING THE APPLICATION OF <br /> DONG YU REAL ESTATE DEVELOPMENT FOR PUD PLAN <br /> APPROVAL AS FILED UNDER CASE PUD-98-01 <br /> <br />WHEREAS, Dong Yu Real Estate Development has applied for PUD plan approval for a six-lot <br /> custom home development which revises the lot layout and roadway configuration <br /> for this 7.68-acre portion of the property which was formerly part of a 22-1ot <br /> subdivision (PUD-87-19, Yee) on approximately 50.36+ acres located on the west <br /> side of Foothill Road at Equus Court; and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - LDR/RDR/OS <br /> (Low Density Residential/Rural Density Residential/Open Space) District; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by <br /> Council on April 21, 1998; and <br /> <br />WHEREAS, Council received the Planning Commission's recommendations for approval of the <br /> development plan; and <br /> <br />WHEREAS, a duly noticed public hearing was held on May 19, 1998; and <br /> <br /> WHEREAS, the City Council finds that the development plan is appropriate for the site. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> Section 1: Approves Case PUD-98-01, the application of Dong Yu Real Estate Development <br /> for PUD plan approval for a six-lot custom home development which revises the <br /> lot layout and roadway configuration for this 7.68-acre portion of the property, <br /> which was formerly part of a 22-1ot subdivision (PUD-87-19, Yee) on <br /> approximately 50.36+ acres located on the west side of Foothill Road at Equus <br /> Court, subject to the conditions shown on "Exhibit B", attached hereto and <br /> incorporated herein by this reference. <br /> <br /> Section 2: The City staff is directed to cause a Notice of Determination to be filed pursuant to <br /> Section 5.4(g) of Resolution No. 77-66. <br /> <br /> <br />
