these new trees along with the existing walnut trees shown to be saved on the plan <br /> shall be recorded on these lots and included in the project CC&Rs. A provision <br /> providing for their replacement within 30 days in the event of their removal shall <br /> be put in place which would require a similarly-sized tree to be planted, except in <br /> the event that an existing walnut tree is determined to have perished due to disease, <br /> in which case it shall be replaced with a 36" box size tree fi'om the approved list of <br /> tree species. These requirements shall be fully disclosed to all prospective buyers <br /> of Lots 3-27 and Lots 37-39. The developer shall coordinate the placement of the <br /> trees on Lot 37 with the owners of 3938 Redwood Ct. and 3931 Fernwood Way in <br /> order to preserve desired views of the ridge from these existing ho~nes. The four <br /> screening trees on Lot 37 may be replaced with smaller trees/shrubs with a <br /> maximum height of 15 ft. and/or the trees shifted away from the common property <br /> line as part of the final design agreed upon by the developer and the owners of <br /> these two existing residences. The developer shall show the proposed design <br /> solution on the plans for review with the tentative map. <br /> <br />24. The height of the retaining wall used at the dripline of the existing oak tree on Lot <br /> I shall have a maximum 5 ft. height which shall be completed by utilizing either a <br /> series of walls outside the dripline and/or by taking up the height on other portions <br /> of the site on Lot 1. The design and location of this wall as well as the grading:of <br /> this lot shall be reviewed by a consulting arborist to ensure tha! it adequately <br /> addresses lhe long term survival of this tree. The final design of these walls and <br /> lot grading shall be submitted for review with the tentative map. <br /> <br />25. The developer shall install automatic sprinkler valves on a time clock for all front <br /> lawn landscaping. <br /> <br />26. All trees used in landscaping be a minimum of 15 gallons in size unless otherwise <br /> noted or conditioned, and all shrubs a minimum of 5 gallons, unless otherwise <br /> shown on the approved landscape plan. <br /> <br />27. The developer shall provide root control barriers and fbur inch perforated pipes for <br /> parking lot trees, street trees, and trees in planting areas less than ten feet in width, <br /> as determined necessary by the Planning Director at the time of review of the final <br /> landscape plans. <br /> <br />28. The developer shall enter into an agreement with the City, approved by the City <br /> Attorney, which guarantees that all landscaping and open space areas included in <br /> this project will be maintained at all times in a manner consistent with the <br /> approved landscape plan for this development.
