<br /> <br />CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br />ALAMEDA COUNTY, CALIFORNIA <br /> <br />ORDINANCE NO. 1760 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF <br />CHEVRON PRODUCTS COMPANY, INC. FOR PLANNED <br />UNIT DEVELOPMENT REZONING AND DEVELOPMENT <br />PLAN APPROVAL, AS FILED UNDER CASE PUD-97-14 <br /> <br />WHEREAS, Chevron Products Company, Inc. has applied for Planned Unit Development <br />rezoning and development plan approval for the construction of a self-service <br />gasoline station and convenience store located at 1797 Santa Rita Road (the <br />southwest corner of Valley Avenue and Santa Rita Road); and <br /> <br />WHEREAS, zoning for the property is C-N (Neighborhood Commercial) District; and <br /> <br />WHEREAS, based on the Initial Environmental Study, a negative declaration was adopted by <br />Council on August 18, 1998; and <br /> <br />WHEREAS, Council received the Planning Commission's recommendations for approval of the <br />rezoning and development plan approval; and <br /> <br />WHEREAS, a duly noticed public hearing was held on August 18, 1998; and <br /> <br />WHEREAS, the City Council finds that the rezoning and development plan are consistent with <br />the General Plan policies of the City of Pleasanton. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br />Section 1: Approves the rezoning of the site located at 1797 Santa Rita Road to PUD (Planned Unit <br />Development) - C (Commercial) District and the development plan for a 24-hour <br />self-service gasoline station and convenience store, subject to the conditions shown in <br />Exhibit "B", attached hereto and made part of this case by reference. <br /> <br />Section 2: The Zoning Map of the City of Pleasant on dated April 18, 1960, on file with the City <br />Clerk, designating and dividing the City into zoning districts is hereby amended by <br />Zoning Unit Map #441, dated August 18, 1998, attached hereto as Exhibit "A", and <br />incorporated herein by reference. <br /> <br />Section 3: The City staff is directed to cause a Notice of Determination to be filed pursuant to <br />Section 5.4(g) of Resolution No. 77-66. <br />
