8. The applicant shall widen and increase the radius of the driveway on Santa Rim Road <br /> subject to the satisfaction of the City's Engineer. <br /> <br />9. The affordable housing program shall be modified to stipulate that priority shall be given <br /> to Pleasanton residents and their relatives, and that the program shall be effective in <br /> perpetuity, and if it is voided in the future, the City would be able to recoup its <br /> Lower-Income Housing Funds and Lower-Income Housing Fees otherwise due. <br /> <br />10. The applicants shall change the name of the project from "Pleasanton Brighton Gardens" <br /> to "Brighton Gardens" or some other name that is not similar to an existing senior <br /> housing complex in the City. The final project name shall be subject to the review and <br /> approval by the Planning Director. <br /> <br />11. The operator of the facility shall maintain at all times a van pool service sufficient to <br /> ensure that the use of the City's Dial-A-Ride service will not be necessary for residents of <br /> the facility. If necessary to adequately serve the residents, the applicants shall add a <br /> second van for the facility. <br /> <br />12. The applicants shall relocate the existing 15 inch sewer line and easement within the <br /> proposed drive aisles of the project. The sewer line and easement relocation shall be <br /> shown on the building permit plans and shall be subject to review and approval by the <br /> City Engineer and Planning Director prior to issuance of building permits for the project. <br /> A new easement for the sewer line shall be recorded prior to issuance of building permits. <br /> The applicants' engineer shall provide all necessary documentation for the City to <br /> abandon the existing sewer line easement and record the new sewer line easement. <br /> <br />13. No building permits may be issued until a Lot Line Adjustment is recorded which merges <br /> the two parcels (Assessor's Parcel Numbers 946-1100-017-01 and 946-1100-014-02) into <br /> one parcel and adjusts the northeast property line adjacent to the Rose Pavilion Shopping <br /> Center to correspond with the shopping center's trash enclosure and fence that encroaches <br /> into the subject project site. <br /> <br />14. The operator of this facility shall keep in full force and effect all required state, county, <br /> and agency licenses required to operate this facility. <br /> <br />15. The applicants shall comply with the recommendations of the noise study prepared by <br /> Charles M. Salter Associates, Inc. dated Revised May 20, 1998. Said recommendations <br /> shall be incorporated/shown on the building permit plans. <br /> <br /> 16. The applicant shall comply with the recommendations of the "Phase II Environmental <br /> Assessment" prepared by Dames & Moore dated January 12, 1998. The consultant shall <br /> certify in writing that the recommendations have been complied with prior to occupancy <br /> of the project. <br /> <br /> <br />
