Ordinance No. 1753 <br />Page Two <br /> <br />Section 1: Pursuant to Government Code Section 65858, the City Council of the City of <br /> Pleasanton does hereby find as follows: <br /> <br /> A. For the following reasons there is a current and immediate threat to the <br /> public peace, health, safety and welfare of its citizens: <br /> <br /> (1) The City has received testimonial information from other local <br /> jurisdictions that fortune-telling may be linked to increases in the <br /> crime rates in those areas in which they are located and in the <br /> surrounding areas. <br /> <br /> (2) The effect of fortune-telling establishments on sensitive land uses <br /> and the concentration of fortune-telling establishments may result in <br /> adverse impacts on commercial districts if such uses are located <br /> there. <br /> <br /> (3) The City needs time to gather information to determine if <br /> fortune-telling establishments result in adverse secondary effects, <br /> and what those effects could be on adjacent residential, recreation, <br /> religious, educational, and other fortune-telling establishments. <br /> <br /> B. For the reasons set forth above, the approval of use permits, conditional use <br /> permits, variances, building permits or other applicable entitlements for <br /> fortune-telling uses result in the threat set forth above to the public peace, <br /> health, safety and welfare of its citizens. <br /> <br /> Section 2: The City Council further finds that: <br /> <br /> A. A temporary moratorium on the processing and approving use permits, <br /> conditional use permits, variances, building permits or other applicable <br /> entitlements for the uses identified herein is necessary to protect the public <br /> health, safety and welfare. <br /> <br /> B. A temporary moratorium will not adversely affect the orderly development <br /> of property or the preservation of property values because other uses <br /> authorized by the existing zoning ordinance and zoning maps remain <br /> available to property owners and to those who wish to operate <br /> fortune-telling and related issues. <br /> <br /> <br />
