CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDINANCE NO. 1752 <br /> <br />AN ORDINANCE APPROVING THE APPLICATION OF THE <br />CITY OF PLEASANTON FOR A MODIFICATION TO AN <br />APPROVED PLANNED UNIT DEVELOPMENT, AS FILED <br />UNDER CASE PUD-85-10-6M <br /> <br />WHEREAS, <br /> <br />the City of Pleasanton has applied for a major modification to an approved <br />Planned Unit Development (PUD) for the Hopyard Village Shopping Center, <br />located at the northeast comer of Hopyard Road and Valley Avenue, to consider <br />amendments to the conditions of approval regarding uses, hours of parking lot gate <br />closure, parking lot lighting, landscaping, and lattice fence extensions for the 52 <br />space eastern parking lot and buildings located at 5725 and 5737 Valley Avenue; <br />and <br /> <br />WHEREAS, <br /> <br />the proposed amendments would implement the settlement agreement between the <br />City of Pleasanton and the property owner, Goble Properties (former owner was <br />Manufacturers Life Insurance Company); and <br /> <br />WHEREAS, zoning for the property is PUD (Planned Unit Development) - C-C (Central <br /> Commercial) District; and <br /> <br />WHEREAS, projects of this nature are categorically exempt from the requirements of the <br /> California Environmental Quality Act (CEQA); and <br /> <br />WHEREAS, Council received the Planning Commission's recommendations for approval of the <br /> proposed modification; and <br /> <br />WHEREAS, a duly noticed public hearing was held on June 16, 1998; and <br /> <br />WHEREAS, <br /> <br />the City Council finds that the new/modified conditions included with this PUD <br />modification are reasonable and will provide the additional assurance needed to <br />protect the neighbors from potential adverse impacts from the shopping center <br />operation while providing the means for the property owner to derive an economic <br />benefit from the shopping center. <br /> <br />THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br />FOLLOWS: <br /> <br /> <br />
