CITY COUNCIL OF THE CITY OF PLEASANTON <br /> <br /> ALAMEDA COUNTY, CALIFORNIA <br /> <br /> ORDNANCE NO. 1750 <br /> <br /> AN ORDINANCE RESCINDING ORDINANCE 1467 WHICH <br /> APPROVED PUD-90-2, A FIVE-LOT RESIDENTIAL PUD ON <br /> PROPERTY LOCATED AT 445 KOTTINGER DRIVE <br /> <br />WHEREAS, on June 19, 1990, the City Council adopted Ordinance No. 1467, which approved <br /> PUD-90-2, an application for planned unit development rezoning and development <br /> plan for a five-lot residential PUD, including the development of four new single <br /> family residences, for property located at 445 Kottinger Drive; and <br /> <br />WHEREAS, eight years have elapsed since the project approval and nothing has been done on <br /> the site; and <br /> <br />WHEREAS, the City's policies and procedures regarding development have changed and staff <br /> and the Planning Commission recommend that this project approval be rescinded <br /> in order that any new project proposed could be reviewed in accordance with the <br /> present policies and procedures; and <br /> <br />WHEREAS, within the last eight years staff has become more experienced with and concerned <br /> about landslides around hillside developments and Council finds that further <br /> geotechnical analysis is needed prior to any site development on this property; and <br /> <br />WHEREAS, actions of this nature pertaining to minor alterations in land use regulations are <br /> categorically exempt from the requirements of the California Environmental <br /> Quality Act (CEQA) and no environmental document accompanies this proposal. <br /> <br /> THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES HEREBY ORDAIN AS <br /> FOLLOWS: <br /> <br /> Section 1: The City Council rescinds Ordinance 1467. <br /> <br />Section 2: The property at 445 Kottinger Drive continues to be zoned PUD-MDR; however, a <br /> development plan will not be approved for the undeveloped eastern portion, until <br /> the property owner submits a new development proposal, including new housing <br /> plans, to the City when he/she is ready to develop the site. The property line <br /> separating the existing single-family home from the eastern lot remains in its <br /> existing location. <br /> <br /> <br />
