Measure F to provide three parking spaces as a staging area access and that the applicant felt it more <br />appropriate to work with the Park district to provide better access to the area. Mr. Rowe noted that the <br />applicant has agreed that Lots 3, 4, and 6 would be split pad lots and the idea of small pad lots around <br />the immediate building area. He noted the importance of there being a padded area for the applicant due <br />to the utilization of post-tension slabs. He provided an overview of the visual analysis. In response to <br />an inquiry by Commissioner Maas, Mr. Rowe noted he would be flexible with the house plans. <br /> <br />Chuck Lemoine, 4456 Foothill Road, expressed appreciation to staff for their work on this project. He <br />noted that the comment in the staff report relating to the one-acre donation to the Park District is not <br />quite accurate. He notes that no amenity is required on the first proposed development. Further, that his <br />children desire to build homes on the back side of the lot and after construction of homes, a donation of <br />10-13 acres would be provided to the Park District. He spoke of the importance of the Park District <br />connecting the trails system throughout the Tri-Valley area; however, the timing for donation of land for <br />the first development is not quite right. Further, he commented on the Measure F requirements and <br />noted requirements have been met with the $145,000 dedicated to the Park District. He noted he would <br />be opposed to dedicating that one-acre property at this time; however, he would be in favor to establish <br />an agreement with the Park District to avoid a lengthy time delay in getting trails connected. Further, <br />that if development of land doesn't occur within a specified period of time, that land would be dedicated <br />to the Park District. He commented on the visual analysis and noted that the development will have a <br />very limited impact on views. Further, that the project is lower in height than the surrounding <br />developments. Mr. Lemoine noted that this process has been conducted for approximately four years <br />and he noted his desire for the process to be continued. <br /> <br />Linda Chavez, 2950 Peralta Oak Court, East Bay Regional Park District, noted that most of the Park <br />District's concerns have been resolved by working cooperatively with the City, the developers, and the <br />Lemoines. Further, she noted that access was one of the largest concerns and that has been addressed <br />through the $145,000 in funding for the access road. She commented on the trails that proceed up the <br />ridge and noted that the Park District is close to closure on the other segments south of this property, and <br />the dedication of the one-acre parcel has been requested. Further, that the trail connections are part of <br />the master plan and dedication of the easement is necessary to complete the trail connection. She <br />requested that the condition relating to the easement remain as part of the conditions. She commented <br />that the modifications to Conditions 88 and 139 clear up the concerns that the Park District had. <br /> <br />In response to an inquiry by Chairperson Roberts relating to timing the trail connection to a couple of <br />years or a five-year period of time, Ms. Chavez stated that five years may be too long a period of time. <br />She noted that trail connections should be completed in approximately one to two years. <br /> <br />Ann Sorensen, 4432 Foothill Road, noted she was in support of the project being approved. However, <br />she noted she was concerned about wording contained in the staff report relating to quit claim deeds and <br />easements and location of new private road. She expressed concern with issues relating to the cattle <br />gate. She noted she would not be in favor of quitclaiming the easement and that she planned on always <br />using the private driveway. She further noted her support with the Lemoines children building homes on <br />the property.
