Plucker noted that staff is recommending that when Mr. Bach comes in with his PUD the issue be <br />revisited at that time. <br /> <br />In response to a question from Commissioner Sullivan about the impacts three homes and the road <br />would have on Mr. Bach, Mr. Bach advised that most of the people on Sycamore Road truly believe in <br />property rights. He stated that Mr. Bozorgzad owns his land and he has Mr. Bach's blessing to do <br />anything within reason on his land. He advised that the 600-foot easement which cannot be seen fully <br />from the top nor the bottom would create an environment for unfavorable activities. <br /> <br />Jack Keane, 417 Sycamore Road, expressed support for the application, noting that he believes the <br />property will be developed at some point and he prefers to see Mr. Bozorgzad as the developer of the <br />property. He noted that while he has children who will be attending Pleasanton Middle School and <br />Valley View this year, he is still opposed to the path. He advised that the negatives it will bring will far <br />out-weigh any of the benefits. He noted that it could create an environment for a "party spot." He <br />advised that the path will lead down to the east-west collector and directly across from that point is a <br />triangular piece of property that will be landscaped. He noted that that piece of property is directly <br />across from his home. He stated that he can see that piece of property becoming another "party spot." <br />He commented that Mr. Bach has been through quite enough with the relocation, and his concerns need <br />to listened to. Mr. Keane advised that there is also the connection at San Antonio which allows access to <br />the Greenbriar development and creek area from the development to the north. He stated that he has <br />heard the complaints regarding the Greenbriar project and other development, and the requests for an <br />easy way to get to the golf course. He noted that the proposed golf course would not be there without <br />development. <br /> <br />John Severini, 433 Sycamore Road, stated that he supports the applicant and he believes that he will do <br />what he says and will develop the property in an appropriate manner. He advised that as long as he is <br />conforming with the zoning he should be able to build a 5,000 or 6,000 square foot house. He stated that <br />he believes it is unfair to not allow him to work on the house on Saturday, particularly in light that <br />Greenbriar is working on Saturdays. Mr. Severini advised that he lives directly across the street from <br />the Bach property and one house east of the Keane property. He noted that no one has been more <br />inconvenienced then them, both on egress and ingress, noise, and dirt. He stated that he is totally <br />opposed to the pedestrian path. He noted that he was in law enforcement for 30 years, and he knows the <br />type of areas in which juveniles congregate. He noted that the triangle area is directly across from his <br />home and that a three-foot berm will be constructed in this area to shield the homes from headlights. He <br />commented that this berm will provide a refuge and hiding place for juveniles. He mentioned that there <br />will be no street lights on Sycamore Road in keeping with the rural character. He stated that this will <br />provide an area for juveniles to congregate and drink and smoke. He stated that he hopes the Planning <br />Commission sees the wisdom of the path on San Antonio to provide the access that the other speakers <br />are wanting. <br /> <br />Wilona Perry, 5848 San Juan Way, stated that she feels a 7,000-square-foot home is too big for the area <br />and that it is not in keeping with the design of Greenbriar or what is in her neighborhood. She noted that <br />this home will be up on the berm and it will be visible from her bedroom window. She commented that <br />the height of 37 feet would be an exception, as she understands the City code is 30 feet. She stated that <br />the design of the homes should be within the City code requirements.
