Commissioner Cooper requested that Page 8, second to last paragraph, be amended to read, "He recommended that the City Council consider expanding the project to 250 homes to provide an incentive for key players to pay for infrastructure." Commissioner Cooper requested that Page 8, last paragraph, be amended to read, "... regulation of chemicals should be done on a case-by-case basis; however, due to state law preemption, this was not possible; therefore, he would support a condition for organic practices only." Commissioner Cooper requested that Page 10, Item No. 2, be amended to read, "Maas votedno." Commissioner Cooper requested that Page 9, first paragraph, be amended to read, "... it is not the responsibility of the City; however, he felt the City shouM advocate a repeal of the mining act of 1872 at higher governmental levels." On order of the Chairperson, the minutes of April 28, 1999, were approved as amended. 3. PUBLIC HEARINGS UP-99-9, Ascona Pizza Company Application for a conditional use permit to allow a proposed pizza restaurant (Ascona Pizza Company) to sell beer and wine after 10:00 p.m. (until 11:00 p.m. on Friday and Saturday) located at 3003 Hopyard Road, Suite A (Hopyard Village Shopping Center).
