4. REVISIONS AND OMISSIONS TO THE AGENDA <br /> <br />Mr. Plucker noted that Item No. 6.d. will be heard at the April 26, 2000. <br /> <br />5. MATTERS CONTINUED FOR DECISION <br /> <br />PUD-99-03, Willia~ Kolb~ Donna Miller. and Gene and Carol Strom - <br />Application for PUD pre-zoning and PUD development plan approval for a residential <br />subdivision consisting of 12 new single-family lots and two existing single-family homes, <br />open space, and public park uses, and public street and infrastructure improvements <br />located on approximately 55.4 acres; and designating an approximately 5.22-acre area for <br />a future senior care facility. The overall project site is unincorporated and is located at <br />11393 Dublin Canyon Road. The Planning Commission will also consider the negative <br />declaration prepared for the project. <br /> <br />Mr. Plucker referenced the staff report dated April 12, 2000, and highlighted key areas contained <br />in the report including background information, Lot 7 design and grading, project description, <br />Condition 27, EVA requirement, open fencing for Lots 1 through 6, Tree No. 110/Payment of <br />Mitigation Fee, stucco, development plan timing, and maximum building height. <br /> <br />In conclusion, Mr. Plucker noted that staff's recommendation is that the Commission forward <br />Case PUD-99-03 to the City Council by making the finding that the proposed PUD Prezoning <br />and PUD Development Plan will not have a significant environmental impact and adopt a <br />resolution recommending approval of Exhibit "C," the draft Initial Study/Negative Declaration <br />for PUD-99-03; make the finding that the proposed PUD Prezoning to the PUD (Planned Unit <br />Development) - LDR, C, and PHS/WO (Low Density Residential, Commercial, and Public <br />Health and Safety/Wildlands Overlay) District and the PUD Development Plan are consistent <br />with the Pleasanton General Plan; making the PUD Development Plan findings as stated in the <br />staff report; and adopting a resolution recommending approval of the PUD Prezoning to the PUD <br />(Planned Unit Development) - LDR, C, and PHS/WO (Low Density Residential, Commemial, <br />and Public Health and Safety/Wildlands Overlay district and recommending approval of the <br />PUD Development Plan subject to the revised draft conditions of approval stated in Exhibit "B." <br /> <br />Discussion ensued relating to the lots being lowered six feet, clarification of the building heights, <br />dimensions of building height and berms, whether the berm has been considered as a noise <br />harder, and the elevation of the buildings relative to the northwest side of the ridge. <br /> <br />Peter MacDonald, 400 Main Street, Suite 210, represented the applicants. He noted that the <br />applicants have addressed each of the issues raised by the neighbors, planning staff, and planning <br />commissioners. He noted that the story poles were placed on Lot 8, and Lot 8 will not be visible <br />in the new plan. Mr. MacDonald noted the applicants still have concerns in relation to Condition <br />27, and he noted the applicants do not wish to retain the EVA road as an easement between the <br />two properties as a secondary access out to Dublin Canyon Road. He noted that this is not a <br />condition that the Fire Department requested or initiated. He advised the Commission that the <br />applicants' preference is for the first two sentences of Condition 27 to be eliminated.
