PLANNING COMMISSION CITY OF PLEASANTON ALAMEDA COUNTY, CALIFORNIA RESOLUTION NO. PC-99-18 RESOLUTION APPROVING THE REQUEST TO MODIFY THE DESIGN AND LOCATION OF THE LOWER PATIO FENCE OF THE PREVIOUSLY-APPROVED COFFEE ROAST EXPRESS BUILDING UNDER CONSTRUCTION AT 780 MAIN STREET, AS FILED UNDER CASE Z-99-25 WHEREAS, Diane and Edward Churka have applied for design review approval to modify the previously-approved Coffee Roast Express building under construction at 780 Main Street by modifying the design and location of the lower patio fence along Main Street; and WHEREAS, zoning for the property is C-C (Central Commercial), Downtown Revitalization, Core Area Overlay District; and WHEREAS, at its duly noticed public hearing of February 24, 1999, the Planning Commission considered all public testimony, relevant exhibits, and recommendations of the City staff conceming this application; and WHEREAS, projects of this nature are categorically exempt from the requirements of the Caiifomia Environmental Quality Act (CEQA); therefore, no environmental document was prepared for this project; and WHEREAS, the Planning Commission determined that the relocation of the lower patio fence would be appropriate, as long as there are no modifications to the design of the planter area with brick borders. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves the request of Diane and Edward Churka to relocate the lower patio fence of the previously-approved Coffee Roast Express building under construction at 780 Main Street, subject to the conditions (which require that no changes be made to the design of the planter area with brick borders), as shown in Exhibit "B," attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
