Amended Cooperative Fee Agreement (b) the Cooperative Fee Developers' and District's <br />obligations under Article IH of this Amended Cooperative Fee Agreement shall survive until <br />such time as all such obligations have been fulfilled: and (c) District's right to collect fees and <br />the Cooperative Fee Developers' obligations to pay fees pursuant to Sections 2.1.2.2 and 2.3 of <br />this Amended Cooperative Fee Agreement shall survive until fees have been paid for all Planned <br />Residential Units. <br /> <br /> ARTICLE XV <br />CITY'S POLICE POWERS <br /> <br /> Section 15.1 City's Police Powers. Nothing in this Amended Cooperative Fee <br />Agreement is intended to, and nothing in this Amended Cooperative Fee Agreement does. <br />infringe on or prohibit the City's exercise of its police powers. This is recognized in several <br />parts of the Amended Cooperative Fee Agreement including Section 7. At any time should the <br />City find that in order to protect public safety, health or welfare, whether for reasons related to <br />school facilities or otherwise, the City may exercise its police powers accordingly. If the City's <br />exercise of its police powers conflicts with its obligations herein or this Amended Cooperative <br />Fee Agreement is determined in any way to prevent the City's exercise of its police powers, the <br />City may withdraw from the Amended Cooperative Fee Agreement. <br /> <br /> ARTICLE XVI <br />SEPARATE COUNTERPARTS <br /> <br /> Section 16.1 This Amended Cooperative Fee Agreement may be executed in <br />separate counterparts, such that signatures appear on separate signature pages. An authentic <br />facsimile copy of an executed signature page shall constitute an original. A copy or original of <br />this document with all signature pages appended together shall be deemed a fully executed <br />agreement. <br /> <br />(continued on next page) <br /> <br /> <br />
