CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 01-112 <br /> <br />A RESOLUTION OF THE CITY COUNCIL ESTABLISHING <br />A COMPENSATION POLICY FOR MILITARY RESERVISTS <br />EMPLOYED BY THE CITY OF PLEASANTON <br /> <br />WHEREAS, <br /> <br />in accordance with state and federal law, any employee who is a member of the <br />California National Guard or a United States Military Reserve organization shall <br />receive, during the employee's first thirty (30) calendar days on active duty or <br />temporary military leave, full salar~y and benefits as if working his/her regular <br />schedule with the City of Pleasanton; and <br /> <br />WHEREAS, the law provides the flexibility for employers to determine the level of <br /> compensation, if any, beyond the thirty day mandate. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Should the active duty or temporary military leave continue beyond thirty days, the <br />employee shall receive the difference between the amount of his/her military pay <br />and the amount he/she would have received if working as regularly scheduled with <br />the City of Pleasanton, for a period extending up to one year from the start of the <br />military leave. During this time period, benefits shall be paid, paid time-off shall <br />accrue, and PERS retirement credit shall be earned, as if the employee were <br />working his/her normal schedule. <br /> <br />Section 2: <br /> <br />Any employee receiving compensation pursuant to Section 1 who does not retum <br />to City service within thirty days of being released from active duty, and who is <br />physically able to return to work, shall have the compensation treated as a loan <br />payable with interest at the rate eamed on the Local Agency Investment Fund. <br />This does not apply to compensation earned during the first thirty calendar days of <br />leave, pursuant to state and federal law. <br /> <br />Section 3: This compensation policy shall not apply to any active duty served voluntarily. <br /> <br /> <br />
