CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, CALIFORNIA <br />RESOLUTION NO. 01-092 <br /> <br />RESOLUTION DENYING CASE PAP-21, THEREBY <br />UPHOLDING THE PLANNING COMMISSION'S APPROVAL <br />OF AN APPLICATION FOR PUD DESIGN REVIEW <br />APPROVAL, AS FILED UNDER CASE PDR-118 <br /> <br />WHEREAS, <br /> <br />the McDonald's Corporation has applied for PUD design review to construct a <br />new, approximately 5,134-sq. fi., fast-food restaurant with drive through and <br />indoor playplace, and for a 5,220-sq. fi. commercial building pad on 1.75 acres of <br />land located at 3001 Bemal Avenue in the Stanley Business Park; and <br /> <br />WHEREAS, zoning for the property is PUD-C (Planned Unit Development - Commercial) <br /> District; and <br /> <br />WHEREAS, at its meeting of May 23, 2001, the Planning Commission approved the application <br /> for PUD design review; and <br /> <br />WHEREAS, within the time specified by the City of Pleasanton Municipal Code, the City <br /> Council appealed the Planning Commission's decision; and <br /> <br />WHEREAS, a duly noticed public heating was held before the City Council on August 21, 2001 <br /> on the appeal; and <br /> <br />WHEREAS, the City Council determined that the proposed design is appropriate for the site. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON RESOLVES <br />AS FOLLOWS: <br /> <br />Section 1: <br /> <br />Denies Case PAP-21, thereby upholding the Planning Commission's approval of <br />the application of the McDonald's Corporation for PUD design review to construct <br />a new, approximately 5,134-sq. ft., fast-food restaurant with drive through and <br />indoor playplace, and for a 5,220-sq. ft. commercial building pad on 1.75 acres of <br />land located at 3001 Bemal Avenue in the Stanley Business Park, subject to the <br />conditions set forth in Exhibit A, attached hereto and incorporated herein by this <br />reference. <br /> <br /> <br />
