CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA ~£80LUTION ND._~' !~3 ACQUIRING AND IMPROVING AN EASEMENT AND RIGHT OF WAY IN THE PROPOSED "ADAMS WA~', SOUTHERLY OF ADAMS COURT IN THE CITY OF PLEASANTON, FOR SIDEWALK AND UNDER- GROUND UTILITY PURPOSES, BY THE CITY OF PLEASANTON, AND AUTHORIZING INSTITUTION OF EMINENT DOMAIN PRO- CEEDINGS FOR ACQUIRING AND POSSESSING CERTAIN REAL PROPERTY THEREFOR. BE IT RESOLVED by the City Council of the City of Pleasanton that it hereby finds and determines and hereby declares as follows: 1. The public interest, convenience, need and necessity require the acquisition, construction and completion by the City of Pleasanton of certain public improvements for public street purposes, to-wit: The acquisition, extension and improvement, including all structures and work and improvements reasonably necessary and appurtenant thereto, of the easement and right of way in the proposed "Adams War', southerly of Adams Court, Pleasanton, California. 2. The public interest, convenience, need and necessity require the acquisition by the City of Pleasanton, for and in connection with said public improvements, of the real property, or interests in real property, hereinafter described. 3. The public interest, convenience, need and necessity require that a fee simple estate, unless a lesser estate is hereinafter expressly described, be taken by the City of Pleasanto~ in and to said real property, or interests in real property, to-wit: the George H. Henry and Laura Henry property, cou~nonly known as a portion of 484 Adams Court, Pleasanton, California. 4. The City Attorney is hereby authorized to take any and all actions necessary on behalf of the City of Pleasanton to acquire title to said property by eminent domain proceedings or otherwise. 5. Said real property, or interests in real property, hereinabove referred to are more particularly described as - 1 -
