CITY OF PLEASANTON <br /> COUNTY OF ALAMEDA <br /> STATE OF CALIFORNIA <br /> <br /> I~£BOLUTIQN ND, 65-170 <br /> <br /> RESOLUTION FINDING AND DECLARING A PUBLIC NEED AND <br /> NECESSITY FOR ACQUIRING AND IMPROVING A PORTION OF <br /> THE PROPOSED BERNAL AVENUE REALIGNMENT, EASTERLY OF <br /> MAIN STREET, IN THE CITY OF PLEASANTON, FOR PUBLIC <br /> STREET PURPOSES, BY THE CITY OF PLEASANTON, AND <br /> AUTHORIZING INSTITUTION OF EMINENT DOMAIN PROCEEDINGS <br /> FOR ACQUIRING AND POSSESSING CERTAIN REAL PROPERTY <br /> THEREFORE. <br /> <br /> BE IT RESOLVED by the City Council of the City of Pleasanton <br />that it hereby finds and determines and hereby declares as follows <br /> <br /> 1. The public interest, convenience, need and necessity <br />require the acquisition, construction and completion by the City <br />of Pleasanton of certain public improvements for public street <br />purposes, to-wit: The acquisition, extension and improvement, <br />including all structures and work and improvements reasonably <br />necessary and appurtenant thereto, of proposed Bernal Avenue <br />realignment, easterly of Main Street, Pleasanton, California. <br /> <br /> 2. The public interest, convenience, need and necessity <br />require the acquisition by the City of Pleasanton, for and in <br />connection with said public improvements, of the real property, <br />or interests in real property, hereinafter described. <br /> <br /> 3. The public interest, convenience, need and necessity <br />require that a fee simple estate, unless a lesser estate is <br />hereinafter expressly described, b~e taken by the City of Pleasantor <br /> <br /> said real property, or interests in real property, <br /> <br />in and to <br />to-wit: <br /> <br />Property of Manning E. Stanley and John F. <br />Stanley, on the northerly corner of the <br />intersection of Main Street and First Street, <br />bounded on the northwest by Southern Pacific <br />Railroad right of way. <br /> <br />The City Attorney is hereby authorized to take any and <br /> <br />all actions necessary on behalf of the City of Pleasanton to <br />acquire title to said property by eminent domain proceedings or <br /> <br />otherwise. <br /> <br />5.
