The records of the Planning Commission, and the appeal off <br />;hell Oil Company on the Application for Conditional Use Permit too <br />:onstruct an automobile service station at First Street and <br />Vineyard Avenue, were duly considered by the City Council. <br /> 2. The Application for Conditional Use Permit by Shell Oil <br />Company on is hereby granted, subject to terms and conditions as <br /> <br />follows'. <br /> <br /> a: Application for details of site plan, architecturall <br />and landscaping approval shall be shown on applicant's plan, and <br />subject to any reasonable conditions as fixed by the Planning <br />Commission. <br /> <br /> b. The applicant or owner, Douglas Safreno, shall <br /> apply for rezoning of the Cortez parcel to the south, changing <br /> :he district from C-O to C-T. <br /> <br /> c. Applicant or owner, Douglas Safreno, shall combine <br /> ~egal descriptions of proposed site and southerly parcel into one <br /> description, so as to come under the Jurisdiction of the Subdi- <br /> vision Co~,,ittee in the event of any future lot-split. The purposse <br /> of this provision is to prevent the southerly parcel being used <br /> to meet lot area requirements for any future application of <br /> adjacent property. <br /> <br /> d. Property owner shall enter an agreement with the <br /> City, approved as to form by the City Attorney, providing that <br /> within five years from date of Conditional Use Permit all existing~ <br /> buildings shall be demolished, and that upon owner leasing or sell~- <br /> the southerly Cortez parcel to applicant at fair market value, <br /> said parcel shall be used only as a part of applicant's automobilee <br /> ~ervice station. <br /> <br /> e. The property owner must dedicate to the City streett <br /> ~ight-of-way at the corner of Vineyard Avenue and First Street <br /> necessary for a 40-foot curb radius, and right-of-way on Vineyard <br /> Avenue necessary for the standard 10-foot sidewalk between the currb <br /> and property line. <br /> <br /> f. A 10-foot wide sidewalk with street tree planters <br /> and street trees must be constructed along the frontage of the <br /> subject property on both Vineyard Avenue and First Street, in <br /> accordance with City ordinances and regulations. <br /> <br /> g. A standard storm water inlet must be constructed too <br />i~eplace the existing side inlet catch basin on Vineyard.Avenue, <br />~nd all on-site drainage must be carried to this inlet in under- <br /> ground conduits. <br /> <br /> <br />
