CITY OF PLEASANTON COUNTY OF ALAMEDA STATE OF CALIFORNIA RESOLUTION NO, 6~-- RESOLUTION FINDING AND DECLARING A PUBLIC NEED AND NECESSITY FOR ACQUIRING AND IMPROVING A PORTION OF TME PROPOSED BERNAL AVENUE REALIGNMENT, WESTERLY OF MAIN STREET, IN THE CITY OF PLEASANTON, FOR PUBLIC STREET PURPOSES, BY THE CITY OF PTAASANTON, AND AUTHORIZING INSTITUION OF EMINENT DOMAIN PROCEEDINGS FOR ACQUIRING AND POSSESSIONG CERTAIN REAL PROPERTY THEREFORE. BE IT RESOLVED by the City Council of the City of Pleasanton that it hereby finds and determines and herby declares as follows::: 1. The public interest, convenience, need and necessity require the acquisition, construction and completion by the City ~f Pleasanton of certain public improvements for public street ~urposes, to-wit: The acquisition, extension and improvement, Lncluding all structures and work and improvements reasonably necessary and appurtenant thereto, of proposed Bernal Avenue realignment, westerly of Main Street, Pleasanton, California. 2. The public interest, convenience, need and necessity require the acquisition by the City of Pleasanton, for and in connection with said public improvements, of the real property, or interests in real property, hereinafter described. 3. The public interest, convenience, need and necessity require that a fee simple estate, unless a lesser estate is ereinafter expressly described, be taken by the City of Pleasant~o~ n and to said real property, or interests in real property, to-wit: Property of Edwin Glaser and Wanda Glaser on the westerly side of Main Street, north of the inter- section of Main Street and the Southern Pacific right of way, commonly known as 117 Main Street, Pleasanton, California. 4. The City Attorney is hereby authorized to take any and ill actions necessary on behalf of the City of Pleasanton to lcquire title to said property be eminent domain proceedings )therwise. - 1 - or
