CiTY OF PLEASANTON <br />COUNTY OF ALAMEDA <br />STATE OF CALIFORNIA <br /> <br /> 66-47 <br />RES[:]LUTIDN Nh. ,, <br /> <br />PROCEDURE FOR DEDICATION OF PUBLIC NEIGHBORHOOD <br />PARKLAND, PAYMENT OF FEES, OR A COMBINATION THEREOF, <br />UNDER THE PROVISIONS OF ORDINANCE NO. 439 (PARKLANDS <br />DEDICATION) <br /> <br /> WHEREAS, Ordinance No. 439, requiring the dedication of <br />neighborhood park land, the payment of fees, or a combination <br />thereof, was adopted on February 2, 1966, became effective on <br />March 7, 1966, and applies to all Tentative Subdivision Maps <br />filed after April 7, 1966; and <br /> <br /> WHEREAS, the City Council has ordained that the procedure <br />under Ordinance No. 439 shall be set forth by resolution; <br /> <br /> NOW, THEREFORE, BE IT RESOLVED that the City Council of <br />the City of Pleasanton sets forth the procedure under Ordinance <br />No. 439 as follows: <br /> <br /> 1. At such time as the Preliminary Subdivision Map is <br />reviewed by the Subdivision Committee, the Co~mittee shall <br />!consider whether neighborhood park areas are required within <br /> said subdivision, whether only fees should be collected for said <br /> subdivision, and whether a combination of both land and fees <br /> should be required within said subdivision. <br /> <br /> 2. The Subdivision Committee shall make a recommendation <br />to the Planning Commission, Recreation Couaaission and subdivider <br />after considering the above-stated alternatives. <br /> <br /> 3. After a Tentative Subdivision Map has been formally <br />submitted for consideration, but prior to Planning Commission <br />action upon said Tentative Map, the Recreation Co~nission shall <br />forward to the Planning Commission a recommendation regarding <br />the alternatives listed above. <br /> <br /> 4. The Recreation Commission shall consider private <br />recreation facilities which may be proposed within said sub- <br />division, under the criteria listed in Section 4(f), Ordinance <br />No. 439. <br /> <br /> 5. The Planning Commission, in considering and approving <br />said Tentative Subdivision Map, shall consider the reco-~,endationnsl <br />of the Recreation Co~aission, and shall specify, as a condition <br />of approval of said Tentative Subdivision Map, whether neighbor- <br />hood park land dedication, the payment of fees, or a combination <br />thereof, shall apply to the Tentative Map. <br /> <br /> 6. At the time of approval of the Tentative Subdivision <br />Map, if private recreation facilities are proposed and a credit <br />is proposed to the developer, the Planning Commission shall <br />condition the Tentative Map upon City Council approval of any <br />credit to be granted. <br /> <br /> 7. If credit under Section 4(f), Ordinance No. 439, is <br />recommended, the Planning Commission shall forward to the City <br />Council the Planning COLL~ission and Recreation Co-~,ission recom- <br />mendations regarding the granting of such credit. <br /> <br /> <br />
