CITY OF PLEASANTON :~ -~ RESOLUTION FINDING AND DECLARING A PUBLIC NEED AND NECESSITY FOR ACQUIRING AND IMPROVING A PORTION OF THE PROPOSED SCHWEEN STREET, 'NORTHERLY OF DIVISION STREET~ IN THE CITY OF PLEASANTON, FOR PUBLIC STREET PURPOSES, BY THE CITY OF PLEASANTON, AND AUTHORIZING INSTITUTION OF EMINENT DOMAIN PROCEEDINGS FOR ACQUIRING AND POSSESS- ING CERTAIN REAL PROPERTY THEREFOR. that follows: 1. require BE IT RESOLVED by the City Council of the City of Pleasantonn it hereby finds and determines and hereby declares as The public interest, convenience, need and necessity the acquisition, construction and completion by the City of Pleasanton of certain public improvements for public street purposes, to=wit: The acquisition, extension and improvement, including all structures and work and improvements reasonably necessary and appurtenant thereto, of proposed Schween Street, northerly of Division Street, Pleasanton, California. 2. The public interest, convenience, need and necessity require the acquisition by the City of Pleasanton, for and in connection with said public improvements, of the real property, or interests in real property, hereinafter described. 3. The public interest, convenience, need and necessity require that a fee simple estate, unless a lesser estate is hereinafter expressly described, be taken by the City of Pleasanton in and to said real property, or interests in real property, to-wit: the Shanahan property, commonly known as 359 Division Street, Pleasanton, California. 4. The City Attorney is hereby authorized to take any and all actions necessary on behalf of the City of Pleasanton to acquire title to said property by eminent domain proceedings or otherwise. 5.
