CITY COUNCIL OF THE CITY OF PLEASANTON <br />ALAMEDA COUNTY, ALAMEDA <br /> <br /> RESOLUTION NO. 01-091 <br /> <br />RESOLUTION APPROVING THE REPEAL OF THE EXISTING <br />PROHIBITIONS REGARDING THE GEOTECHNICAL <br />SETBACK LINE AT OAK TREE FARM AND THE ADOPTION <br />OF NEW REGULATIONS REGARDING MITIGATION FOR THE <br /> <br />AREA <br /> <br />Curdn Construction Company has requested the modification of the existing <br />regulations applying within a geotechnical setback line (commonly called the <br />"Berlogar Line") that were established by the City in 1992 in conjunction with the <br />approval of Tentative Map 6563, the Oak Tree Farm subdivision; and <br />the City of Pleasanton has certified a Final Supplemental Environmental Impact <br />Report ("SEIR") which includes an evaluation of the requested modification and <br />proposed mitigation measures for potentially significant impacts; and <br />the Planning Commission, following noticed public hearings on July 29, 1998 and <br />June 13, 2001, found that the repeal of existing prohibitions and adoption of new <br />regulations were consistent with the policies in the General Plan and <br />recommended approval of the project, with conditions implementing the <br />mitigation measures proposed in the SEIR; and <br /> <br /> the City Council, after holding a noticed public hearing on August 7, 2001, has <br /> found that feasible mitigation measures are available to avoid potentially <br /> significant impacts and has incorporated them into the project approval as <br /> conditions (Exhibit "^"); and <br /> to ensure implementation of the mitigation measures over time, a "Mitigation <br /> Monitoring Reporting Plan" (Exhibit "B") has been prepared which specifies how <br /> the required mitigation measures are to be carried out; and <br /> the City Council has further found that the modifications are consistent with the <br /> policies in the General Plan, particularly those of the land use and safety elements. <br /> <br /> <br />
