The proposed location of the conditional use and the conditions under which it would be operated or maintained will not be detrimental to the public health, safety, or welfare, or materially injurious to the properties or improvements in the vicinity. The project is conditioned so that the sale of alcohol will cease once the kitchen closes, thereby ensuring that food service is always available in conjunction with alcohol service. The restaurant will not be offering any live music, DJ's, dancing or entertainment, thus avoiding possible adverse impacts on the adjacent tenants. Offices and commercial uses should not be effected by the extended hours of alcohol service at the proposed restaurant. Since the residential units are sufficiently far away from the site staff does not anticipate that the proposed restaurant/bar wilt be an adverse impact on the residential community. The proposed conditional use will comply with each of the applicable provisions of the zoning ordinance. The site's Freeway-Commercial zoning conditionally permits the establishment of bars. The proposed use complies with all relevant sections of this ordinance. Granting a conditional use permit to the applicants for a bar is consistent with the City's ability to regulate zoning as listed in the Municipal Code Chapter 18.124 "Conditional Uses." the Planning Commission determined that the restaurant/bar will be compatible with the surrounding businesses and will not deffimentally affect the surrounding uses and properties. NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON RESOLVES THE FOLLOWING: Section 1. Approves Case PCUP-17, the application of S.B. Restaurant d.b.a. The Elephant Bar Restaurant for a conditional use permit to serve alcohol after 10:00 p.m.until I1:00 p.m. Monday to Thursday, and after I0:00 p.m. until 12:00 a.m. Friday and Saturday, located at 5104 Hopyard Road, subject to the conditions shown in Exhibit "B," attached hereto and made part of this case by reference. Section 2. This resolution shall become effective 15 days after its passage and adoption unless appealed prior to that time.
