Resolution No. PC-2000-53 <br />Page 2 <br /> <br /> local businesses and residents thereby conforming to the purpose of the C- <br /> F district. <br /> <br />The proposed location of the conditional use and the conditions <br />under which it would be operated or maintained will not be <br />detrimental to the public health, safety, or welfare, or materially <br />injurious to the properties or improvements in the vicinity. <br /> <br />The project is conditioned so that the sale of alcohol will cease once the <br />kitchen closes, thereby ensuring that food service is always available in <br />conjunction with alcohol service. The restaurant will not be offering any <br />live music, DJ's, dancing or entertainment, thus avoiding possible <br />adverse impacts on the adjacent tenants. Offices and commercial uses <br />should not be effected by the extended hours of alcohol service at the <br />proposed restaurant. Since the residential units are sufficiently far away <br />from the site staff does not anticipate that the proposed restaurant/bar wilt <br />be an adverse impact on the residential community. <br /> <br />The proposed conditional use will comply with each of the <br />applicable provisions of the zoning ordinance. <br /> <br />The site's Freeway-Commercial zoning conditionally permits the <br />establishment of bars. The proposed use complies with all relevant <br />sections of this ordinance. Granting a conditional use permit to the <br />applicants for a bar is consistent with the City's ability to regulate zoning <br />as listed in the Municipal Code Chapter 18.124 "Conditional Uses." <br /> <br />the Planning Commission determined that the restaurant/bar will be <br />compatible with the surrounding businesses and will not deffimentally <br />affect the surrounding uses and properties. <br /> <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF <br />PLEASANTON RESOLVES THE FOLLOWING: <br /> <br />Section 1. <br /> <br />Approves Case PCUP-17, the application of S.B. Restaurant d.b.a. The <br />Elephant Bar Restaurant for a conditional use permit to serve alcohol after <br />10:00 p.m.until I1:00 p.m. Monday to Thursday, and after I0:00 p.m. until <br />12:00 a.m. Friday and Saturday, located at 5104 Hopyard Road, subject to <br />the conditions shown in Exhibit "B," attached hereto and made part of this <br />case by reference. <br /> <br />Section 2. This resolution shall become effective 15 days after its passage and <br /> adoption unless appealed prior to that time. <br /> <br /> <br />
