(1) On February 15, 2000, the City Council adopted Resolution No. 00-013 cerfifyi~ rig Fired Environmental Impact Report (State Clearing House No. 964)13005) for the S~n Fr~ciaco Water Department Bemal Property Specific Plan (the "EIR''). (2) On August ,2000, the City Council, after conducting a duly noticed 'l~blic hearing and making appropriate findings, adopted a Statement of Overriding Consid~-ations and a Mitigation Monitoring Program end approved the "Initial Project Approvals" (as hereinaik'r defined). In connection with City's review and approval of the Initial Project Approvals, City, acting as the lead agency under CEQA, reviewed the EIR and d~tarmilled that none of the elements set forth in Public Resources Code §21166 or §15162 of the Stat~ CEQA Guidelines ("CEQA Guidelines") exists and therefore determined, in accordance with §15096 of the CEQA Guidelines, that no subsequent or supplemental EIR is required to be prepared prior to granting the Initial Project Approvals. (3) On ,2000, the City Council adopted Resolution No. approving a Specific Plan for the Bemal Property (the "Specific Plan'~ and designation of the property as a Planned Unit Development (the "PUD") consisting of a first phase of approximately 170 acres of Commercial, Office, Medium and High Density Residential, Open Space, and Park and Recreational Use Districts, and of a second phase consisting of approximately 330 acres of unspecified use. (4) On , 2000, the City Council adopted Ordinance No. rezoning approximately 70 acres of the Bernal Property and prezoning approximately 430 acres to Planned Unit Development zoning. As part of Ordinance No. , the City Council also approved the Master Development Plan for the fu-st phase of the development of the site, consisting of 40.5 acres of commercial/office uses, acres of High Density Residential, __ acres of Medium Density Residential and acres of a neighborhood lnrk and associated public improvements. (8) On ,2000, the City Council adopted Resolution No. authorizing the execution of the Bemal Interchange Construction Agreement. (9) On ,2000,the City Council adopted Resolution No. , authorizing the execution of the Affordable Housing Agreement, which agreement sets forth the understanding of the parties with respect to the affordable housing component of the Project. The approvals, development policies and agreements described in subparagraphs (I) through (9) above shall be collectively referred to herein as the "Initial Project Approvals."
