(1) On February 15, 2000, the City Council adopted Resolution No. 00-013 <br />cerfifyi~ rig Fired Environmental Impact Report (State Clearing House No. 964)13005) for the <br />S~n Fr~ciaco Water Department Bemal Property Specific Plan (the "EIR''). <br /> <br /> (2) On August ,2000, the City Council, after conducting a duly noticed <br />'l~blic hearing and making appropriate findings, adopted a Statement of Overriding <br />Consid~-ations and a Mitigation Monitoring Program end approved the "Initial Project <br />Approvals" (as hereinaik'r defined). In connection with City's review and approval of the Initial <br />Project Approvals, City, acting as the lead agency under CEQA, reviewed the EIR and <br />d~tarmilled that none of the elements set forth in Public Resources Code §21166 or §15162 of <br />the Stat~ CEQA Guidelines ("CEQA Guidelines") exists and therefore determined, in accordance <br />with §15096 of the CEQA Guidelines, that no subsequent or supplemental EIR is required to be <br />prepared prior to granting the Initial Project Approvals. <br /> <br />(3) On ,2000, the City Council adopted Resolution No. <br />approving a Specific Plan for the Bemal Property (the "Specific Plan'~ and <br />designation of the property as a Planned Unit Development (the "PUD") consisting of a first <br />phase of approximately 170 acres of Commercial, Office, Medium and High Density Residential, <br />Open Space, and Park and Recreational Use Districts, and of a second phase consisting of <br />approximately 330 acres of unspecified use. <br /> <br /> (4) On , 2000, the City Council adopted Ordinance No. <br /> rezoning approximately 70 acres of the Bernal Property and prezoning <br />approximately 430 acres to Planned Unit Development zoning. As part of Ordinance No. <br /> , the City Council also approved the Master Development Plan for the fu-st phase of <br />the development of the site, consisting of 40.5 acres of commercial/office uses, acres of <br />High Density Residential, __ acres of Medium Density Residential and acres of a <br />neighborhood lnrk and associated public improvements. [Acreage to be provided.] <br /> <br /> (5) On ,2000, the City Council adopted Ordinance No. <br />this Development Agreement. <br /> <br />, approving <br /> <br /> (6) On ,2000, the City Council adopted Resolution No. <br /> . approving a growth management allocation for the Property pursuant to the Growth <br />Management Agreement <br /> <br /> (7) On , 2000, the City Council adopted Resolution No. <br />authorizing the execution of the Bernal Bridge Construction Agreement. <br /> <br /> (8) On ,2000, the City Council adopted Resolution No. <br />authorizing the execution of the Bemal Interchange Construction Agreement. <br /> <br /> (9) On ,2000,the City Council adopted Resolution No. , <br />authorizing the execution of the Affordable Housing Agreement, which agreement sets forth the <br />understanding of the parties with respect to the affordable housing component of the Project. <br /> <br />The approvals, development policies and agreements described in subparagraphs (I) through (9) <br />above shall be collectively referred to herein as the "Initial Project Approvals."
