PC-2000-49 <br /> <br />RESOLUTION RECOMMENDING APPROVAL OF THE PREANNEXATION <br />DEVELOPMENT AGREEMENT AND GROWTH MANAGEMENT AGREEMENT <br />FOR GHC BERNAL INVESTORS, LLC (GREENBRIAR HOMES COMMUNITIES, <br />rNC 0 <br /> <br />WHEREAS, state law gives public agencies the authority to enter into long term agreements with <br /> developers concerning development; and <br /> <br />Ordinance 1729 of the City of Pleasanton sets forth a Growth Management Pmgrarn <br />(Chapter 17.36 of the Pleasanton Municipal Code) which authorizes the City to <br />enter into agreements with developers to achieve orderly growth rotes and <br />residential development; and <br /> <br />GHC Bemal Investors LLC ("GHCBI") has made an application to the City for a <br />Preannexation Development Agreement and Growth Management Agreement for <br />the Bemal Property project; and <br /> <br />WHEREAS, the City certified a Final EIR for Bemal Property project; and <br /> <br />a duly noticed public hearing concerning the Pmannexation Development <br />Agreement and Growth Management Agreement was held by the Planning <br />Commission on August 9, 2000; and <br /> <br />the Planning Commission considered all the information presented at the public <br />hearing by GHCBI, staff, and members of the public regarding the terms of the <br />Prearmexafion Development Agreement and Growth Management Agreement. <br /> <br /> <br />
